Position Overview
As a General Counsel for Intellectual Property, you will undertake the following responsibilities:

Provide Legal Guidance on:
Intellectual property regulations, including trademarks, copyrights, patents, trade secrets, and compliance with FAR/DFARs data rights acquisitions.

Assess the legality, interpretation, and enforceability of contracts, grants, cooperative agreements, and other transactions, including litigation related to bid errors, protests, disputes, and claims. Address international cooperative research and development agreements, foreign military sales, and the disclosure of classified or proprietary information.

Engage in matters related to controlled information, special access programs, and other legal concerns.
Participate as a member of acquisition strategy panels and serve as an advisor to source selection authorities.
Offer advice on statutory and regulatory compliance.

Oversee major program acquisitions and procurements, including contract formation, administration, termination, classified contracts, technical data rights, fiscal law, and the disclosure of information to foreign governments and entities.

Evaluate the releasability of records, including classified and proprietary information.

Address administrative law issues, including GAO and DoD IG audits, executive branch standards of conduct, and fiscal law matters concerning the appropriate use of appropriated funds.

Draft and negotiate contracts or other legal documents required by the agency.
Make substantive recommendations regarding proposed legislation. Under the direction of the General Counsel and Deputy General Counsel, resolve complex legal issues.

Determine when consultation or coordination with other government offices or commercial organizations is necessary; refer matters requiring guidance to supervisors.

Organize work effectively and meet deadlines with minimal supervision.

Handle complex, novel, and challenging legal issues, executing special assignments for the General Counsel on urgent and significant legal matters.

Provide legal counsel in meetings with senior officials from the MDA and the Department of Defense (DoD).

Represent the MDA in discussions with other departments and agencies, including the Department of Justice (DOJ), the Government Accountability Office (GAO), and foreign government officials.

Assist the DOJ or other DoD counsel in litigation involving the agency, including responding to discovery requests, compiling documents, preparing legal briefs, and preparing agency personnel for litigation.

Represent the agency in judicial and administrative proceedings, such as those before the Government Accountability Office and U.S. Courts.

In addressing legal matters, it is essential to evaluate the propriety and advisability of proposed, ongoing, or past agency actions.

Given the significance of various programs or initiatives, you must apply creativity in developing sound legal responses that uphold the propriety of client actions, policies, practices, and positions.

When a proposed agency action is inadvisable, suggest innovative alternatives to achieve the underlying objectives within legal boundaries.


Required Specialized Experience:
A

Intellectual Property Law:
Expertise in intellectual property law, including trademarks, copyrights, patents, trade secrets, and compliance with FAR/DFARs data rights acquisitions.

Contracts:
Knowledge of federal acquisition and procurement law.
C

International Law:

Familiarity with international law, including statutes, treaties, case law, regulations, and policy directives related to research and development; understanding of international implications in acquiring major weapons systems; international agreements; and foreign military sales.


General Knowledge:

Understanding of federal judicial and administrative litigation processes, inter-relationships among DoD components, and interactions between DoD and other executive branch agencies and Congress.

Experience in identifying and analyzing legal issues, conducting legal research, summarizing findings, and providing sound legal advice.

Experience in ensuring compliance with the Freedom of Information Act and security classification procedures.
Experience with fiscal, administrative, and personnel law; standards of conduct and ethics.
Experience assisting senior attorneys with audit procedures and practices of the GAO and DoD IG.
Qualification standards for attorney positions are outlined in DoD Directive 1442.2, "Personnel Actions Involving Civilian Attorneys."

Education Requirements:
Applicants must be graduates of an American Bar Association accredited law school and in good standing with a state bar, the District of Columbia, U.S. Territory, or the Commonwealth of Puerto Rico.
