We are seeking a highly skilled Senior Intellectual Property Attorney to join our in-house legal team at WEX. As an In-House Counsel for Marketing and Brand Management, you will play a critical role in supporting our global marketing and product teams.

Job Description

This is a challenging opportunity for a seasoned attorney with expertise in corporate transactional law involving marketing/advertising and intellectual property issues. Your primary responsibility will be to provide legal support and guidance to our marketing and product teams, ensuring that all marketing and branding content and materials comply with applicable laws, rules, and regulations.

  • You will develop and maintain a clear understanding of WEX's products, services, and competitive landscape to provide informed legal advice.
  • Review and advise on marketing and branding content and materials to ensure internal consistency and compliance with applicable laws, rules, and regulations and industry best practices.
  • Advise on legal issues related to all forms of marketing and brand strategy and related brand management issues.
  • Partner with Procurement and Commercial Legal to draft and negotiate marketing, branding, and advertising agreements.
  • Oversight of all aspects of WEX's IP portfolio, including providing guidance on and supporting registration, prosecution, renewal, enforcement, and managing litigation related to WEX's trademarks, patents, copyrights, and trade secrets.

As a key member of our in-house legal team, you will also be responsible for:

  • Assisting in the development of strategies and implementation of action plans for extracting value from WEX's IP portfolio and any new WEX inventions and/or innovations.
  • Fostering awareness of, collaboration on, and respect for WEX's IP portfolio and related strategies, policies, and processes.
  • Conducting IP due diligence and providing legal advice for/on mergers, acquisitions, and other strategic transactions and engagements.
  • Managing outside IP counsel to ensure that WEX's IP portfolio is maintained properly, our IP rights are enforced aggressively to prevent infringement and protect our competitive advantage, and all IP matters are handled efficiently and cost-effectively.
  • Maintaining a current understanding of relevant laws, regulations, industry standards, and policy trends relevant to WEX's products and services.
  • Collaborating closely within the WEX Legal Department to design, modify, and implement company policies and processes to ensure legal compliance with internal policies, as well as applicable laws, rules, and regulations.
  • Developing training materials and conducting training sessions for Marketing, Product, and other business teams.

To be successful in this role, you should have:

  • A Juris Doctor (JD) degree from an accredited law school.
  • Active membership in good standing with at least one state bar.
  • No less than 5 years of experience in corporate transactional law involving marketing/advertising and intellectual property issues and considerations.
  • In-house legal experience.
  • Experience within the financial services, fintech, or technology sector preferred.
  • Excellent communication (oral and written) and interpersonal skills.
  • Exceptional organizational skills, attention to detail, and the ability to multitask, prioritize, and adjust as priorities shift.
  • Strong reviewing and drafting skills; commitment to quality through demonstrated accuracy and thoroughness.
  • Ability to work independently, yet still be team-oriented and collaborative.
  • Ability to build strong internal relationships and to act as a legal resource for business and functional leaders globally.
  • Ability to apply strong problem-solving skills and excellent judgment to develop practical, business-oriented, and strategic solutions in a fast-paced environment.
  • Sound judgment; ability to clearly make reasoned recommendations; ability to anticipate risk and be proactive in planning and communicating accordingly, including determining who should be informed and engaged.
  • Proficiency in Microsoft Office and GSuite; ability to ramp up quickly on other applications and systems, including document management systems.
  • Must successfully pass a background investigation.

Salary Estimate: $120,000 - $150,000 per year, depending on experience.
