Performs professional level real estate work including acquisition of real property and easements, disposal, abandonment and/or exchange of City owned property in support of capital and non-capital projects.

**Essential Functions**:

- Reviews Capital Project right-of-way acquisition requests by analyzing plans and directives to determine size, shape and location of property to be acquired.
- Assists in acquiring easements and right-of-way for City purposes; conducts research for all City Departments concerning property status (ownership, type of rights, encumbrances, reservations, etc.) impacting public and private lands; works with project managers and engineers to resolve owner issues regarding property impacts (such as site solutions) due to the City’s project.
- Orders and reviews title reports to verify proper title transfer to the City; performs title searches to determine the validity and adequacy of existing right-of-way dedications, easements, and ownership; conducts field inspections of parcels being acquired.
- Prepares information packages for orders and reviews appraisals prepared by independent appraisers.
- Manages the preparation of purchase and escrow agreements, easements, deeds, mortgage releases, consents and other instruments needed in the acquisition or disposal of real property interest.
- Prepares and maintains complete records of right-of-way legal descriptions, transactions, deeds, agreements and other related documents; reviews documents prepared by private engineering firms for City acceptance.
- Prepares or assists in preparing Council action packets, including Council Reports and ordinances for abandonment/extinguishment, property purchases or sales, and for authorization for the City Manager to execute leases, licenses, deeds and easements.
- Assists in managing the terms and conditions of consultant contracts for appraisals and all other professional services as required.
- Responds to inquiries on real property matters related to the Capital Improvement Program.
- Supports the development and maintenance of a comprehensive inventory/database of real estate, including City-owned property and right-of-way.
- Performs other related duties as assigned.

**Minimum Qualifications/Special Requirements/Success Factors**:
Bachelor’s degree in Public or Business Administration, Real Estate, Economics, or a related field. Two years of professional level experience in at least one of the following: public sector right-of-way acquisition, condemnation, negotiation, sale, disposal, title review, appraisal, and/or escrow processing.

**_Any equivalent combination of education, training and experience that provides the required knowledge, skills and abilities is qualifying. One year of relevant experience may be substituted for each year of required education._**

**Knowledge of**:

- Real estate principles, including all aspects of real estate contract law including purchase and sale agreements, commercial leases, license agreements, development agreements, condemnation, prior rights, and other issues
- Administration of right-of-way use, purchase, and sale in the public sector
- Valuation of property rights through traditional and non-traditional appraisal techniques
- Legal aspects of real estate including city, state, and federal laws, ordinances, and policies
- Ordinances and processes for dedications, abandonments and release of easements
- Zoning and the influence of zoning on property values
- Land development practices and procedures
- Environmental assessments related to real estate transactions

**Ability to**:

- Prepare and execute real property legal instruments
- Prepare cost estimates for right-of-way and property acquisitions
- Handle multiple projects simultaneously and use good judgement in prioritizing work assignments.
