Business Management Associates (BMA) is seeking EEO investigator performing work that involves fact-finding, analysis, writing, and applying equal opportunity principles to identify and solve problems by investigating, conciliating, negotiating, or consulting with a wide range of organizations and activities. The EEO investigator is involved in exploring and conciliating allegations of discrimination, developing the investigative plan, gathering facts and data, and evaluating the theories of discrimination to ensure proper execution of the investigative approaches. Advises employer and employee on the applicable statutes, organizational policies, and practices, and writing the investigation report.

RESPONSIBILITIES & DUTIES:

  • Drafts the investigative plan based on the accepted claims and bases. This involves a detailed analysis of each allegation and the related evidence, both pro and con, the application of personnel regulations, guidelines, principles, and court decisions, and an amalgamation of substantive programmatic input from other sources within the office.
  • Serves as EEO investigator to aggrieved employees or applicants for employment who believe they have been discriminated against. Determine what facts are needed to resolve the disputed employees/applicants' issues through interviews with agency officials, supervisors, other employees and examining pertinent records and instructional materials. When necessary, reviews personnel records of individuals being investigated and those of other persons who are directly concerned with the matter in question. Interviews are conducted as testimony or affidavits.
  • Attempt resolution before investigation. Chooses the course of action most likely to result in a satisfactory solution to the matter. Suggests action for management, using a sensible and sound approach that management can reasonably be expected to implement.
  • Identifies organizations where systemic equal employment problems exist because of many complaints or suspected of living because of low morale, proposed reduction-in-force, high employee turnover, etc. Assist in the planning and conducting internal investigations and presents findings and recommended solutions to management officials.
  • Serves as a participant in drafting the final agency decision or determining whether there is discrimination based on the record after a thorough investigation has been made.
  • Provides input to proposed recommending action items based on knowledge of problem areas that have emerged during investigation processing

QUALIFICATIONS & REQUIREMENTS:

  • Possess EEO knowledge and skill to ascertain facts, analyze, meditate, and resolve allegations/complaints of discrimination through knowledge of Equal Employment Opportunity principles, concepts, laws, regulations, policies, and relevant precedent decisions to recognize and solve difficult EEO problems, and to make technical recommendations for decisions in complaint matters.
  • Skill in communicating information orally to in writing to a wide range of audience (i.e., managers, supervisors, employees, management officials, union officials, employ representatives, etc.) to provide clear, comprehensive advice and guidance to resolve workplace conflict and disputes, as well as present informative reports and feedback.
  • Broad general knowledge of human resource or personnel administrative policies and practices, including appeals and grievances, labor relations, employee relations, position classification, recruitment, and selection, so that he/she will know where to obtain expert technical advice or assistance to answers questions, solve problems or understand technical personnel issues.
  • Knowledge and experience in using conflict resolution techniques (e.g., mediation, conciliation, facilitation, and conflicting coaching) to resolve to challenge and highly complex Equal Employment Opportunity (EEO) complaints, pre-administrative and pre-negotiated grievances, and workplace disputes.
  • Skill in investigating by analyzing and evaluating investigative approaches, identifying claims and bases, leading others to respond to questions, taking necessary actions, and negotiating for a settlement.
  • Skill in communicating with managers/supervisors and employees at all levels of the organization to negotiate changes in employment practices and resolve differences between employees, supervisors, and managers.

EDUCATION & EXPERIENCE:

  • Bachelor's Degree required
  • Must have a certification for investigation in the last two years
  • Three (3) years of experience working in investigation
  • Must have the ability to identify claims, analyze information based on evidence, and understand the application of laws and applicable statutes.
