Primary Responsibilities

Investigate complaints and prosecute charges of professional misconduct against members of the Kentucky Bar Association

 In complaint and investigative files, review and analyze materials submitted by the complainant, respondent, or any other person; obtain all necessary court records, bank records, and other documentation; summarize and present results of the investigation to the Inquiry Commission for its consideration and decision

 In alternative disposition files (Alt3Cs), review file, request information as necessary from respondent or complainant via telephone, email, or written documentation; discuss in an effort to facilitate a resolution without requiring the attorneys to file a written response; meet with other OBC attorneys to discuss the files to determine if matter can be

closed or opened for a formal written response.

 In charge files, litigate the case; includes acting as counsel of record for the KBA; drafting the charge; handling all post-charge motions; attempting resolution through consensual discipline; trial preparation; trying the case before a Trial Commissioner;

drafting of briefs; making oral arguments to the Character and Fitness Committee, Board of Governors, and Kentucky Supreme Court.

 In restoration matters, review file to ensure that all legal requirements for applicants' restoration to the practice of law have been met; investigate any questions arising from applications; prepare memoranda to the Executive Director and Chief Bar Counsel summarizing Deputy Bar Counsel's review.

 In reinstatements, act as counsel of record for the KBA; includes investigating applications for reinstatement; acting as counsel of record for the KBA before the Character & Fitness Committee; presenting oral arguments to the Character and Fitness Committee, Board of Governors, and Kentucky Supreme Court.

Additional Responsibilities:

 Assist in the presentation of the Ethics and Professionalism Enhancement Program (EPEP), a remedial ethics program offered annually by the Office of Bar Counsel;

 Strongly encouraged to speak at Continuing Legal Education events, especially those sponsored by the KBA (Kentucky Law Update, Annual Convention, New Lawyers' Program, etc.)

 Perform various other duties relating to the regulation of the Kentucky legal profession, as directed by the Board of Governors and the Executive Director and pursuant to authority in SCR 3.

Minimum Requirements

EDUCATION: Juris Doctorate required.

EXPERIENCE, TRAINING, OR SKILLS: Minimum of 1 year of related legal experience.
