We are seeking a highly skilled Economic Analyst/Economist to join our team, specializing in environmental enforcement. The ideal candidate will possess advanced expertise in applying economic principles and analysis to litigation, enforcement actions, regulatory affairs, and public policy, particularly within the context of environmental enforcement cases. This role will involve conducting sophisticated economic analyses to assess financial implications, evaluate compliance, and determine liability in environmental enforcement actions led by the Environmental Protection Agency (EPA). The Economic Analyst/Economist will collaborate closely with multidisciplinary teams, including legal experts, technical specialists, and government officials, to develop effective enforcement strategies and achieve successful outcomes.
Experience Required:
· Specialization in the application of economics to litigation, enforcement, regulatory affairs, and public policy.
· Demonstrated history of applying economic analysis to remedial cost recovery, civil penalty actions, settlement negotiations, and dispute resolution in EPA enforcement cases.
· Sound working knowledge of EPA's economic models and their applications to various entities including businesses, private organizations, government agencies, and non-profit entities.
· Track record of effectively applying economic principles and models to complex legal and regulatory issues within the environmental enforcement context.
· Experience in conducting economic analyses to assess financial capabilities, evaluate compliance, and determine liability in enforcement actions.
· Strong analytical skills and ability to communicate economic concepts and findings effectively to non-specialist audiences, including legal teams and regulatory authorities.
· Familiarity with relevant laws, regulations, and policies governing environmental enforcement, including EPA regulations and guidelines.
· Proven ability to work collaboratively with multidisciplinary teams, including attorneys, technical experts, and government officials, to achieve desired outcomes in enforcement cases.
Task:
· Conduct financial analysis of individual Potentially Responsible Parties (PRPs), including sole proprietors or business partners, to assess their ability to contribute to response costs at a site.
· Analyze the financial capability of business PRPs to finance response costs using federal tax returns, financial statements, and other relevant financial information provided by the PRP to EPA.
· Assess the financial capacity of government organizations acting as PRPs, such as municipalities, counties, state agencies, or universities, to contribute to response costs at a site.
· Evaluate the financial ability of non-profit PRPs, including governmental and non-governmental organizations such as educational institutions, hospitals, and service organizations, to finance response costs at a site.
· Review and analyze financial assurance documents provided by PRPs to fulfill their financial responsibility obligations under settlements, ensuring compliance with EPA criteria and guidance.
· Conduct structural analysis of complex corporate organizations to understand liability for cleanup response costs, utilizing corporate tax returns, financial statements, and publicly available corporate documents.
· Assist EPA enforcement teams in negotiating with PRPs on financial and corporate structural issues in enforcement cases, including drafting documents, reviewing settlement agreements, and providing advice during negotiations.
· Provide expert witness testimony in mediation, administrative hearings, or judicial trials, assisting EPA and DOJ enforcement attorneys in preparing expert reports, reviewing documents, and drafting questions for examination of witnesses.
· Assist EPA enforcement staff in reviewing compliance with cleanup settlements and orders involving financial issues, including calculating economic benefits derived from non-compliance with CERCLA requirements.
· Collaborate with OSRE and Regional case teams to develop and test financial analysis tools, such as spreadsheets and databases, to support expert financial and corporate analysis in enforcement cases.
Preferred Skill:
· Advanced economic analysis: Proficiency in applying sophisticated economic models and methodologies to assess financial implications, liability, and compliance in environmental enforcement cases.
· Regulatory expertise: In-depth understanding of EPA regulations, guidelines, and policies related to environmental enforcement, enabling accurate interpretation and application of regulatory requirements.
· Negotiation skills: Ability to effectively negotiate settlements and agreements with parties involved in enforcement actions, leveraging economic analysis to achieve favorable outcomes for the EPA.
· Communication proficiency: Clear and concise communication skills to convey complex economic concepts and findings to diverse stakeholders, including legal teams, regulatory authorities, and non-specialist audiences.
· Interdisciplinary collaboration: Experience collaborating with multidisciplinary teams, including attorneys, technical experts, and government officials, to integrate economic analysis into enforcement strategies and achieve successful case outcomes.
