About the Role: Real Estate Development Sr. Counsel


With minimal oversight, the Real Estate Development Sr. Counsel will provide legal services in support of new store development, permitting, construction, and lease administration. Work includes the development of new locations (both ground lease and built-to-suit) and mergers & acquisitions.


Responsibilities


  • Prepare and negotiate new leases (25-35 new units per year), lease amendments, and related documentation, without much supervision.
  • Lead the due diligence process for new locations.
  • Prepare and negotiate vendor contracts as it pertains to the construction of new units.
  • Oversee preparation of documents needed in the ordinary course of lease administration.
  • Provide advice and counsel to support enterprise-wide lease administration, new unit development, and construction efforts.
  • Ensure that standard forms of real estate legal documents are updated as necessary/desirable to reflect current best practices.
  • Provide legal support with general corporate/miscellaneous matters as needed (e.g., review of vendor contracts, non-disclosure agreements, etc.).
  • Review title commitments and surveys and resolve title problems.



Education and Experience Requirements


  • Juris Doctor degree from an accredited U.S. law school.
  • Licensed (in good standing) to practice law in the United States, preferably in the State of North Carolina.
  • Six (6) or more years of practice in a law firm or corporation representing public and/or private companies with respect to complex commercial real estate transactions. Multi-unit retail experience preferred. Law firm experience required.


Required Knowledge, Skills, or Abilities


  • Detailed knowledge of, and competence in advising clients with respect to, commercial real estate transactions, with emphasis on retail leasing especially ground lease and build-to-suit transactions.
  • Experience running a real estate deal from start to finish without much supervision.
  • Experience analyzing, interpreting, and clearly communicating legal strategies and requirements to/for non-lawyer colleagues.
  • Experience working effectively within a team of legal and non-legal professionals.
  • Experience representing multi-unit franchisors or franchisees preferred.
  • Commercial leasing experience with regard to retail/service tenants preferred.
