Introduction

Delaware's Attorney General, the State's chief law enforcement officer, has a broad responsibility to combat crime, uphold civil rights, safeguard families, provide legal services to entirety of state government, and fight fraud. 

In the Civil Division, approximately 80 attorneys provide legal support to the executive branch agencies in the form of general counsel advice, administrative hearing prosecutions, board representation, and all stages of civil litigation.

Summary Statement

The Department of Justice ("DOJ"), Civil Division, Fiscal Integrity and Protection Unit, seeks a Deputy Attorney General ("DAG") to provide legal advice to the Office of Unclaimed Property and the State Lottery Office, divisions of the Delaware Department of Finance.

The salary of $87,458 for the Deputy Attorney General I position applies to candidates who hold active bar admission

Essential Functions

This DAG will represent the State Escheator and the Office of Unclaimed Property in connection with the administration of the State's Unclaimed Property program.  Duties for the State Escheator include:  providing counsel related to unclaimed property reporting and examinations of corporate entities to determine compliance with the State's escheat law; providing counsel related to the processing of claims for unclaimed property; representing the State Escheator in claim appeal proceedings before the Tax Appeal Board, a 5 member quasi-judicial tribunal that hears appeals related to claims; representing the State Escheator in litigation; and providing counsel with respect to procurement and contracting, legislation and regulations, FOIA, personnel matters and other matters.

Duties for the State Lottery Office include:  providing legal advice relating to procurement and contracting, multistate agreements for shared Internet gaming platforms, and licensing denials, suspensions and revocations; periodically filing or updating trademarks; providing advice with respect to the exclusion of individuals from casinos and internet gaming; and providing counsel with respect to legislation and regulations, FOIA, personnel matters and other matters.

This DAG may handle additional assignments as directed by the State Solicitor, Deputy State Solicitor, Unit Head, or Assistant Unit Head.

Job Requirements

The DAG should be able to take a proactive approach to assisting its agency clients.  Therefore, a successful candidate should have the ability to work with the State Escheator and the State Lottery Office to identify potential issues and assist the clients in addressing such issues to minimize or avoid future legal action.

The DAG should be able to work independently, meet deadlines, communicate clearly with client agencies, and have a demonstrated legal ability and a thorough knowledge of relevant laws.  Candidates must possess excellent writing, research, and statutory interpretation skills and be proficient in contract drafting, administrative law, and regulatory compliance. Experience in gaming laws and regulations as well as litigating cases before an administrative hearing officer is helpful but not required.  Membership in the Delaware Bar is required.
