Job Description Assistant Attorney General - White Collar and Commercial Enforcement The White Collar and Commercial Enforcement Division of the Utah Attorney General’s Office has an opening for a full-time attorney enforcing laws related to consumer protection, professional licensing, securities, and real estate. Our division represents the Department of Commerce in civil actions before state and federal courts as well as in administrative proceedings before boards, commissions, and administrative law judges. Our attorneys work with client agencies within the Department of Commerce—the Divisions of Consumer Protection, Professional Licensing, Securities, and Real Estate—in developing cases and executing litigation strategies. Our division’s mission is to make Utah’s marketplace safe and fair by combating unlawful commercial activities and building trust in our economic landscape. We are committed to serving the public, and we work collaboratively with our client agencies to: protect consumers from deceptive business practices; regulate the professional standards for over thirty professions, from midwives to funeral services and nearly everything in between; stop the unlicensed and fraudulent sales of securities and commodities; and oversee the professional standards for real estate brokers, appraisers, and mortgage lenders. Our team is on the front line of Utah’s litigation over the opioid crisis; the challenge of unconscionable pricing of insulin and other diabetic drugs; the addictive features of social media companies; and actions against elder-abuse, patient abuse, false advertising, and Ponzi schemes. Successful applicants can maintain their own caseload, assist and mentor other attorneys and staff, collaborate with clients, maintain high professional standards, and set and meet meaningful goals. We are looking for colleagues who are strong listeners, writers, and communicators; who are skilled in civil litigation and trials; and who have an enthusiasm for being part of a team. *This posting will be open until filled and may close without notice.* Responsibilities Manage and guide paralegals and staff. Conduct all levels of civil litigation from initial intake through investigation, pleadings, expert and fact discovery, trial, appeal, and post-judgment. Handle high-profile and complex cases. Build and maintain positive relationships with clients and colleagues. Communicate, write, and listen well. Advise clients and colleagues on complex issues of law and regulation. Learn new skills and practice areas as needed. Potential travel to various court locations and stay overnight in and outside of Utah. Minimum Qualifications Find representing and litigating the public’s interest rewarding. Strong interpersonal skills and an enthusiasm for working on teams. Experience with civil litigation and client management. Ability to work independently and prioritize own tasks while overseeing and assisting others. Superb writing skills. Firm understanding of civil procedural and evidentiary rules. Commitment to meeting the highest work-product, professionalism, and ethical standards. Knowledge of modern technology in the practice of law. A Juris Doctorate is required. Preference will be given to candidates with over five years of relevant post-law school experience. Supplemental Information This position is based in Salt Lake City and is not suitable for a candidate seeking full-time remote work. Risks found in the typical office setting, which is adequately lighted, heated, and ventilated, and require a candidate to engage in, for example, safe use of office equipment, avoiding trips and falls, observing fire regulations, etc. Typically, the employee may sit comfortably to perform the work; but there may be some walking, standing, bending, carrying light items; driving an automobile, etc. Special physical demands are not required to perform the work. A conditional offer of employment will be made pending satisfactory completion of a background investigation. Must be able to travel as required. Valid driver license required to drive a motor vehicle on a highway in this state per Utah Code § 53-3-202(1)(a). Salary is calculated based on initial Bar admittance year, less any years not practicing law, as outlined below.
