Position Summary: Under the direction of the Executive Deputy Counsel for Budget, Compliance and Operations, the Risk Management and Litigation (RML) Associate Counsel engages in difficult and complex legal and policy work that has significant legal, operational and policy impact on the New York City Public Schools (NYCPS). The RML Associate Counsel will monitor compliance with applicable laws and regulations, including Commissioner’s Regulation Part 130 Relating to Substantial Equivalency of Instruction in Nonpublic Schools, and will assist with investigations, manage litigation, and provide legal advice on high-profile legal, statutory, and regulatory issues of major importance that have the potential for broad impact on public and nonpublic schools. Performs related work.

Reports to: Executive Deputy Counsel for Budget, Compliance, and Operations

Direct Reports: Attorneys

Key Relationships: General Counsel, Executive Deputy Counsel, NYCPS Counsel, Assistant Corporation Counsel, and NYCPS program office staff in the Offices of: Nonpublic and Charter Schools, Finance, Language Access, Intergovernmental Affairs, and the Division of Information and Instruction Technology (DIIT). Acts as a liaison to the New York City Law Department on related litigation.

ResponsibilitiesLitigation-Related Responsibilities
  • Consults with attorneys in the Office of Corporation Counsel and acts as a liaison on litigations.
  • Provides legal advice on litigation, anticipated litigation, and policy initiatives.
  • Conducts in-depth legal research and analysis.
  • Drafts legal memoranda.
  • Conducts fact investigation and analyzes and summarizes findings.
  • Drafts legal documents, including motions, affidavits, legal memoranda, settlement agreements, and substantial equivalency findings.
  • Drafts communications to NYCPS staff and nonpublic school officials.
  • Assists with the implementation of stipulations of settlement in class actions and major litigations.
  • Informs legal staff and senior NYCPS officials of significant legal decisions impacting pending matters.
  • Provides advice to Senior NYCPS officials regarding new legislation, regulatory developments, and federal and state guidance.
  • Assists in developing policies and procedures to implement key initiatives.
Compliance and Policy-Related Responsibilities
  • Assists in conducting substantial equivalency reviews, including, but not limited to, attending school visits to nonpublic schools, doing fact investigation, and assisting with drafting letters, reports, and findings.
  • Reviews State and Federal regulations and guidance and evaluates their impact on the NYCPS.
  • Analyzes and reports on the effects of new City, State, and Federal legislation.
  • Conducts research on legal and operational issues.
  • Advises NYCPS offices/divisions concerning legal issues impacting their operations and policies.
  • Gathers data and information related to substantial equivalency reviews, which may include attending site visits to nonpublic schools.
  • Assists with the compliance and implementation of Commissioner’s Regulations and Chancellor’s Regulations.
  • Works with program offices to assist with implementation of State and Federal grant funding requirements, including Titles I, II, III and IV of Every Student Succeeds Act (ESSA).
  • Provides direct support to program offices to develop and review policies and procedures that comply with legal mandates.
  • Assists senior members of OGC in preparing for meetings with relevant personnel and people internal and external to the Department.
  • Addresses high-priority, confidential situations, and manages confidential data with the highest level of professional discretion and independent judgment.
Operations-Related Responsibilities
  • Acts as a liaison to key government agencies to ensure proper inter-agency coordination and management of key objectives.
  • Assists with developing enhancements to NYCPS databases to ensure and monitor compliance with legal mandates.
  • Assists with tracking developments in ongoing investigations and pending litigation in databases, electronic dashboards, and spreadsheets.
  • Inputs relevant data and generates reports from databases and electronic dashboards.
  • Communicates with a wide variety of central staff, school personnel, and external vendors, providing knowledge and guidance and responding to feedback.
Other Responsibilities
  • Assists with the training and supervision of junior attorneys (Level 2) in the Risk Management and Litigation Unit, as requested by the Executive Deputy Counsel for Budget, Compliance and Operations.
  • Assists with preparing and conducting presentations for staff in NYCPS program offices and attorneys in the Office of General Counsel.
Qualification Requirements:Minimum
  • Admission to the New York State Bar; and either 2 or 3 below.
  • One year of satisfactory United States legal experience subsequent to admission to any state bar; or
  • Six months of satisfactory service as an Agency Attorney Intern (30086).

To be assigned to AL III, candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.

NOTE: Selected candidates must remain members of the New York State Bar in good standing for the duration of their employment.

Salary: $106,607 - $111,107

(Internal candidates who are selected for this position and who currently hold comparable or less senior positions within the DOE will not earn less than their current salary.)
