Position Overview:
The Law Clerk will work directly with and support the Workers' Comp Minor Law Attorneys and the Managing Attorney. This role involves collaboration with other departments such as Personal Injury, Administration, and Intake, as assigned. The primary responsibility of the Law Clerk will include drafting Right-to-Sue Notices and Complaints. The Law Clerk may also be assigned special projects requiring direction from Management or other Pod Leaders.
Primary Responsibilities:
Draft approximately 20 Right-to-Sue Notices and Complaints monthly.
Conduct initial consultations and follow-up meetings with prospective clients.
Draft and finalize retainer and related forms for signed clients.
Act as an interpreter in meetings with clients, facilitating clear communication.
Maintain and review client records, ensuring all information is up-to-date within case management systems.
Process correspondence, prepare mailings, and manage daily updates on tasks and deadlines.
Regularly review deadlines to ensure compliance with departmental protocols.
Assist with drafting DFEH complaints to secure Right to Sue Notices.
Draft Two-Week letters, including demands to preserve records and requests for employment records.
Directly communicate with clients to answer questions and provide updates on their cases.
File complaints and ensure proper follow-up on service of process.
Adhere to department litigation protocols and maintain timely preparation of correspondence and court forms.
Assist in managing cases in state and federal court, including preparation of notices, motions, and documentation.
Assemble documents for court filing and arrange deliveries to judges’ chambers.
Prepare shells for discovery, organize responses, and manage document production.
Draft, file, and serve notices/forms related to case settlements, such as Notice of Settlement and Request for Dismissal.
Perform other duties as assigned by Management and/or Pod Leaders.
Competencies/Skills:
Bilingual Spanish Required: Ability to communicate fluently in both English and Spanish.
Working knowledge of workers' compensation law.
Exceptional attention to detail and organizational skills.
Ability to handle confidential and sensitive information with discretion and tact.
Strong written and verbal communication skills.
Qualifications:
Bachelors degree preferred
Prior experience or internships in a legal setting preferred.
