Position Overview

The Office of Legal Affairs/Office of the General Counsel is tasked with delivering legal services to the System, organized by practice groups aligned with the corporation's business needs. The Employment practice group offers legal counsel and guidance on a broad spectrum of employment matters and consults on various litigation-related issues as necessary. Attorneys within this group are available to provide insights on system policies, support operational needs regarding employment matters, and ensure compliance with legal obligations. The Associate Counsel role supports the Chief Employment Counsel in fulfilling these responsibilities.

Key Responsibilities

Under the guidance of the Chief Employment Counsel, the Associate Counsel will:

  • Offer strategic legal advice and serve as a consultant to management, Human Resources, and other business partners on a variety of employment-related issues, including recruitment, hiring, benefits, compensation, performance management, disciplinary actions, terminations, internal investigations, leaves of absence, employee relations, discrimination, harassment, retaliation, wage and hour compliance, and regulatory compliance.
  • Address complaints regarding potential violations of employment and labor laws, including investigating claims, drafting internal memoranda, and preparing external responses to civil rights agencies.
  • Draft, review, and revise employment-related policies and procedures.
  • Negotiate, draft, and finalize settlement agreements concerning employment matters.
  • Oversee external counsel as needed, including reviewing litigation-related documents and collaborating on litigation strategies.
  • Monitor relevant legislation, regulations, and case law related to employment issues, providing proactive advice to stakeholders.
  • Advise senior leadership on company-wide initiatives impacting employees, including workforce reductions and performance management strategies.
  • Assist in supervising the system's EEO staff responsible for handling accommodation requests and EEO complaints.
  • Conduct training sessions and develop training materials for staff.
  • Perform additional duties as assigned by the Chief Employment Counsel.

Minimum Qualifications

1. A bachelor’s degree or equivalent, along with an LLB or JD from an accredited law school; admission to the New York State Bar.

2. A minimum of three (3) years of experience in legal practice following admission to the Bar, focusing on litigation, corporate law, contracts, labor relations, or employee relations; or

3. Two (2) years of legal practice experience post-Bar admission, with two (2) years in a professional or managerial capacity in relevant fields.

Preferred Qualifications

  • Admission to the New York State Bar and federal district courts.
  • At least five (5) years of legal practice experience post-Bar admission.
  • At least five (5) years of experience in employment law and litigation.
  • Experience working with healthcare clients or in the healthcare sector.
