The Retirement Team is a cohesive unit comprising seven legal professionals and a legal secretary.
This team provides counsel to the Retirement Board and the San Francisco Employees' Retirement System (SFERS), which oversees the management and operation of the City's retirement plans. This includes responsibilities such as managing system assets, adjudicating disability benefit claims, and processing benefit distributions.
SFERS caters to around 75,000 members and beneficiaries, managing assets totaling approximately $35 billion.Additionally, the Retirement Board oversees the San Francisco Deferred Compensation Plan (SFDCP), which serves over 34,000 participants with assets nearing $5 billion.
The Retirement Team addresses a wide range of municipal issues affecting the Retirement Board and SFERS, including topics related to pension benefits, investment portfolios, and the SFDCP.
The Team also represents SFERS in administrative hearings concerning industrial and ordinary disability retirement applications for employees from various city departments, including the Community College District and the School District, before the California Office of Administrative Hearings, and may also defend these administrative decisions in court.
Deputy City Attorney ResponsibilitiesThe lead attorney on the Team serves as the general counsel for both the Retirement Board and SFERS. Three attorneys specialize in providing investment guidance and facilitating investment transactions.
Three additional attorneys focus on managing and presenting disability benefit cases, with two of them balancing their workload between disability cases and benefits advisory roles.
We are looking to fill a position that will focus on both disability benefit cases and providing benefits advice.
The responsibilities outlined below represent a sample of the duties to be assigned and are not exhaustive:
- Preparing and presenting disability retirement applications during administrative hearings, as well as defending these decisions in court.
- Providing legal advice on public agency benefits laws and regulations, including issues such as workers' compensation double recovery offsets, the application of the Gilmore rule, and death benefits matters (including beneficiary designations, competing claims from surviving spouses, and required estate documents).
- Responding to subpoenas for benefits-related information.
- Drafting legislation pertaining to retirement topics.
- Reviewing and approving contracts for legal compliance.
- Conducting formal solicitations for external legal counsel.
