PRC's legal department is dedicated to providing advocacy for Social Security disability and healthcare access to residents in San Francisco. Our legal services utilize a harm reduction approach, focusing on the most vulnerable populations within the community, including those experiencing homelessness, non-English speakers, active substance users, and other marginalized groups. We offer in-house legal services in English, Spanish, and Chinese, with interpretation services available for additional languages.

The Legal Advocacy Program offers two primary legal services through the Disability Advocacy Program (DAP) and the Equal Access to Healthcare Program (EAHP). Depending on individual circumstances, clients may qualify for one or both services.

Role Overview:

PRC is seeking a Staff Attorney to become part of its Legal Advocacy program, delivering direct representation to low-income individuals in their pursuit of Social Security disability benefits, Supplemental Security Income (SSI), the Cash Assistance Program for Immigrants (CAPI), and healthcare programs in San Francisco.

The EAHP Staff Attorney will provide legal representation and consultation to low-income clients living with HIV and/or mental health issues, assisting them in accessing healthcare (Medi-Cal, Medicare, Covered CA, Office of AIDS programs, etc.) and public disability benefits (SSI/SSDI, CAPI, etc.). Additional populations served include LGBTQIA+, individuals experiencing homelessness or at risk of homelessness, non-English speakers, and other at-risk communities.

Key Responsibilities:

  1. Assessment: Conduct individual assessments to identify needs related to healthcare access and disability benefits. Assist clients in overcoming barriers to healthcare access and benefit entitlements, including medical care, treatments, and psychological evaluations.
  2. Benefits Advocacy: Provide direct legal assistance and representation to clients. Aid clients in applying for public disability benefits such as SSI, SSDI, and CAPI, while addressing health insurance issues including Medicare and Medi-Cal. Advocate for clients throughout the claims process, negotiating with relevant agencies as necessary. Gather and develop supporting medical evidence, and file appeals and necessary documentation.
  3. Hearings: Prepare cases for appeal and represent clients before Administrative Law Judges or other tribunals. File necessary documents for the appeals process, conduct legal research, and draft pre- and post-hearing legal briefs. Prepare clients for testimony and formulate questions for cross-examination of expert witnesses. Challenge unfavorable decisions through appeals to the Appeals Council or other appellate bodies.
  4. File Management: Create and maintain confidential client files, documenting reviewed documents and laws/policies, correspondence prepared on behalf of clients, and case progress. Regularly update and maintain client records in case management and billing databases.
  5. Training: Provide training and outreach to consumers and providers as requested.
  6. Special Projects: Assist with special projects as assigned.

Qualifications:

  • Active member of the California State Bar in good standing.
  • Preferred: Two (2) years of experience in public benefits and/or healthcare advocacy.
  • Ability to maintain computer databases independently.
  • Preferred: Familiarity with mental health issues, HIV/AIDS, and state and federal laws regarding disability benefits (SSI, SSDI, OA-HIPP, ADAP, Covered California, Medi-Cal, Medicare, etc.).
  • Essential: Ability to work sensitively and effectively with low-income individuals, those with mental health impairments, individuals living with HIV/AIDS, people of color, active substance users, individuals with a history of homelessness or incarceration, and members of the LGBTQIA+ community.
  • Ability to collaborate effectively with service providers.
  • Ability to occasionally lift 10-20 pounds.
  • Preferred: Knowledge of Harm Reduction theory and practice as applied to legal services.
  • Bilingual and bicultural (Spanish, Cantonese, Mandarin, Arabic, Vietnamese, or Russian) highly desirable.
