Position Overview:
This role is integral to the Field Reports division and operates under the guidance of the Labor Compliance supervisor. The primary focus is to ensure adherence to both state and federal labor regulations, including the Davis-Bacon and Related Acts (DBRA), specifically for federally funded highway construction initiatives. This position plays a crucial role in facilitating accurate reporting of prevailing wages, fringe benefits, apprentice utilization, and addressing employee wage disputes. The findings are then communicated to relevant parties including contractors and subcontractors, ensuring that all federal labor regulations are consistently applied across the board. Additionally, this role is accountable for reporting to management regarding compliance findings during the annual Single Audit.
The State of Arizona promotes a work environment that values flexibility, independence, and trust. Many employees across various agencies are engaged in the State's Remote Work Program, allowing them to perform their duties from home, in offices, or designated hoteling spaces. All work, including remote tasks, should be conducted within Arizona unless prior authorization for exceptions is obtained.
Key Responsibilities:
Essential duties include, but are not limited to:
- Overseeing and verifying contractor compliance with DBRA regulations, which involves reviewing wage determinations, payroll documentation, conducting employee interviews, and assessing fringe benefits and apprenticeship records. Documenting findings and ensuring follow-up actions are taken.
- Evaluating and approving contractor apprentice and trainee documentation to ensure compliance with legitimate unions, state agencies, and contractor programs. Compiling these documents, entering them into relevant databases, and communicating results with the United States Department of Labor (USDOL), ADOT Field Offices, and Contractors.
- Processing requests for additional classifications, wage rates, and fringe benefits for submission to the USDOL for their endorsement.
- Assisting the supervisor in investigating and resolving wage violation complaints from contractor employees, which may necessitate in-state travel and overnight stays, including the use of a State vehicle.
- Supporting the supervisor in generating reports and developing tracking methodologies.
Required Knowledge, Skills & Abilities:
Knowledge of:
- Davis-Bacon labor regulations as outlined in section 29 of the Code of Federal Regulations and Federal Highway Administration (FHWA) section 1273.
- FHWA guidelines and policies related to construction practices.
- Regulations and policies from the United States Department of Labor.
- Data analysis and preparation.
- Effective written and verbal communication.
- Utilizing FAST software.
- Proficiency in various software applications, including Microsoft Office and Google Workspace.
- Convey technical information to non-technical audiences.
- Perform basic mathematical calculations.
Preferred Qualifications:
The ideal candidate will possess at least two years of experience in the review and evaluation of payroll documentation.
Pre-Employment Requirements:
A valid Arizona Class D Driver License is required for this position.
Benefits:
The Arizona Department of Administration provides a comprehensive benefits package, which includes:
- Sick leave
- Vacation time with 10 paid holidays annually
- Paid Parental Leave - Up to 12 weeks of paid leave for a newborn or newly-placed foster/adopted child (pilot program).
- Health and dental insurance
- Retirement plan
- Life insurance and long-term disability insurance
- Optional employee benefits such as short-term disability insurance, deferred compensation plans, and supplemental life insurance.
The opportunity for a full-time or part-time remote work schedule enhances work/life balance, leading to higher job satisfaction and productivity. Remote work arrangements are at the discretion of management and are not guaranteed.
Retirement:
Participation in the Arizona Retirement System (ASRS) is mandatory.
