Brief Summary of Job Duties:
Under the direction of the Director, the specialist is responsible for overseeing all components of the J-1 Exchange Visitor Program, while also providing assistance with employment-based visa processing for H-1B, TN, E3, U.S. Permanent Resident, and dependent statuses.
Acts as an Alternate Responsible Officer for the Department of State and a Designated School Official, representing the University to the Department of Labor and USCIS.
Maintains a comprehensive understanding of federal immigration-related agencies (USCIS, ICE, CBP), immigration laws and regulations, and university policies.Serves as the primary J-1 contact for academic departments, organized research units, national research centers, and the UC systemwide Education Abroad Program Office for the hosting and/or hiring of non-U.S. citizens in academic and certain staff titles. Advises J-1 scholars and dependents regarding immigration laws and regulations, and completes federally required SEVIS-event reporting. Monitors the health and welfare of J-1 scholars and dependents, ensuring compliance with health insurance regulations. Provides orientations and assists scholars with employment, travel, and cultural adjustment issues.
In collaboration with the Immigration Counselor, processes employment-based visas (H-1B, TN, E-3) as well as Labor Certification and Permanent Resident cases.
Counsels foreign nationals, academic departments, faculty, and staff on non-immigrant and immigrant visa statuses, and assists foreign nationals in planning complex, long-range visa strategies to obtain and maintain employment permission and/or legal U.S. immigration status. Oversees the preparation and submission of visa documents to immigration agencies and assists individual employees in resolving immigration-related issues. Trains department personnel on J-1 Scholar and Employment-Based visa processes and regulations. Maintains records using appropriate databases (FileMaker, ISD, ISSM, SEVIS, iCert). Develops and implements cultural programming, and prepares reports and analyses as needed.
Required Qualifications:
Bachelor's degree in related area and/or equivalent combination of education and experience.
High degree of discretion, initiative, sound judgment and confidentiality.
Knowledge of common organization- or research-specific and other computer application programs.
Strong communication and interpersonal skills to communicate effectively, both verbally and in writing.
Strong organizational skills.
Ability to multi-task with demanding timeframes.
Preferred Qualifications:
1-3 years Experience and knowledge of the Student and Exchange Visitor Information System (SEVIS) as it applies to J scholars and their dependents.
1-3 years Skill in advising and counseling, including cultural sensitivity, specifically pertaining to people from other countries and English-as-a-second-language speakers.
Special Conditions of Employment:
Must be a legal permanent resident or citizen of U.S.
in order to be an Alternate Responsible Officer for the Student Exchange Visitor Information System (SEVIS) of the Department of Homeland Security.

Using specialized knowledge of federal immigration, visa and labor regulations, exercises independent judgment and provides informed advice regarding type of visa or the sequence of visas required for hiring an individual within a particular time frame, and where appropriate, assists with obtaining a permanent resident immigrant status for the individual and immediate family members.
Consults with Academic Personnel, department chairs and MSO's/AA's and effectively recommends about the most appropriate non-immigrant visa for an individual given their nationality and previous immigration history in the United States.
Counsels UCSB research scholars and foreign faculty on procedures for employment at UCSB as well as processing time frames and visa specific immigration requirements and considerations.
Serves as the UCSB Alternate Responsible Officer for the U.S. Department of State and as a UCSB Designated School Official for USCIS as well as the Department of Labor.Primary person to counsel J-1 scholars and their dependents and oversees the creation of their DS-2019 documents, the reporting of their arrival and departure to and from campus, and the performance of federally mandated reporting to Department of Homeland Security for SEVIS-reportable events.
Monitors the health and welfare of J-1 scholars and dependents as well as compliance with J-1 regulations for health insurance and off-campus activities.
Plans, designs, and provides orientations and cultural enrichment programming for J-1 scholars and dependents.Counsels J-1 scholars and employment-based (H-1B, TN, E-3) visa holders on visa options and regulations, submission procedures, how to maintain status, and benefits for immediate family members.
Prepares and initiates applications through the U.S. Department of Labor for prevailing wage determinations and labor certifications.Analyzes prevailing wage determinations of the Employment Development Department (EDD) of the Department of Labor and resolves differences with department requests for rate of pay.
Provides specific and ongoing education and instruction to campus units, and analysis of documentation provided by campus units for preparing H-1B, TN, and E-3 nonimmigrant petitions.
Reviews and submits applications to Citizenship & Immigration Services for non-immigrant and immigrant visas for academic titles and other eligible positions on campus.
In the absence of the Immigration Counselor, must be able to step into this role without hesitation.Serves as contact for academic departments, organized research units, national research centers and the UC systemwide Education Abroad Program Office for the hosting and/or hiring of non-U.S. citizens in academic titles and some special staff titles.
Knowledgeable of federal immigration laws, regulations, policies and procedures (Department of Homeland Security, Department of Labor, Department of state), and knowledge of University policies.
25% Data Analysis and Databases:
Evaluates and approves department requests for initial applications and extensions for J visa documents for scholars in the UCSB SEVIS Administrative Database and forwards to Administrative Assistant III for processing.
Advises departments and scholars to ensure that scholars arrive within the 30-day limit of the J-1 program start date by monitoring dates in the SEVIS RTI database and making changes as needed.
Authorizes the transfer of J visa scholars between UCSB and other universities in the SEVIS RTI database.Uses the OISS Scholar Database to manage complex timeframes, ensure deadlines are met and track the progression of scholars and academic employees in obtaining the J-1, H-1B, TN, E-3 statuses.
Monitors SEVIS Alerts and collects data to ensure compliance with J-1 and employment-based visa regulations.Researches, analyses and contributes to the annual report for the Institute for International Education for research scholars in all non-immigrant visa categories.
In the absence of the Immigration Counselor, responsible for oversight of data entered by the International Scholar Assistant in the fsaATLAS database and Excel logs related to the ongoing caseload.
Responsible for entering critical employment-related data in the Department of Labor's iCert database to produce an approved Labor Condition Application (LCA), required in the filing of an H-1B or E-3 petitions.
5% Training and Supervision:
Trains and supervises the MSO's/AA's in over 60 academic departments and campus research units in J-1 application procedures, compliance with J-1 and employment-based visa regulations, the EDD Prevailing Wage Application, the Labor Condition Application, employment-based visa petitions (H-1B, TN, E-3), and Labor Certification and Permanent Resident documentation.
Responds to faculty and staff inquiries regarding business procedures and timelines, and facilitates the proper submission of J-1 and employment-based visa requests to OISS.
Develops forms and documents, and updates business procedures for submission of immigration requests and authorizations.Creates accounts for and trains MSO's/AA's on how to use the UCSB SEVIS Administrative Database for the J visa scholars.
Reviews and analyzes database submissions to improve trainings and/or modify procedures.Oversees the development of content for the OISS website that provides information to the campus on J-1 application procedures and regulations, and U.S. employment authorization and Labor Certification as they relate to employment categories available for UCSB use.
Trains department users on the use of the UCSB SEVIS Admin database.
5% Policies and Procedures:
Reviews changes in federal regulations related to non-immigrant visa statuses (F, J, H-1B, E-3, TN, B-1, B-2, WT, WB). Interprets changes in regulations and recommends changes in campus policies and procedures. Writes corresponding directives, web sites, and instructions for campus units to use.
Reviews changes in federal regulations related to immigrant visa statuses obtained through the following categories: outstanding researcher/professor, national interest waiver, labor certification, asylum, U.S. "green card" lottery, marriage to U.S. citizen or U.S. permanent resident, and U.S. citizenship. Interprets changes in regulations and recommends changes in campus policies and procedures. Writes corresponding directives and instructions for campus units to use.
Coordinates immigration advising and petition submissions with outside counsel as needed.
Liaises with campus units (Academic Personnel; Office of Research) and with government agencies (Dept. of State; Dept. of Labor; Dept. of Homeland Security; USCIS) to enhance OISS procedures and coordinate responses to urgent immigration issues.
Participates in ongoing professional development provided by government agencies, professional associations, and Scholar Advisors Networks to update knowledge and practices that inform campus policies and procedures.
