Compensation Overview

The annual base salary range for this position reflects a nationwide market range and encompasses a wide spectrum of salaries for this role across the country.

The actual salary will be influenced by various factors, including the role's scope, complexity, and location; the candidate's skills, education, training, credentials, and experience; as well as other employment conditions.

What Is the Opportunity?

Under general supervision, this position is tasked with investigating, evaluating, reserving, negotiating, and resolving assigned General Liability related Bodily Injury and Property Damage claims.

Ensures quality claim handling throughout the claim life cycle, including customer interactions, coverage assessments, investigations, evaluations, reserving, litigation management, negotiations, and resolutions, while maintaining compliance with internal and external quality standards and state-specific regulations.

Acts as a consultant and training resource, serving as a technical point of contact for the field and business partners.

This role does not involve managing staff.

Key Responsibilities
Handles assigned severe claims directly.

Delivers quality customer service and ensures timely coverage analysis and communication with insured parties based on policy information and case facts.

Consults with management regarding the use of Claim Coverage Counsel as necessary.

Conducts thorough investigations for each claim through prompt and strategically appropriate communication with relevant parties, including policyholders, claimants, law enforcement, witnesses, agents, medical providers, and technical experts to ascertain liability, damages, and contribution potential.

Interviews witnesses and stakeholders; collects necessary statements as appropriate.
Completes external investigations as required based on case specifics.

Engages in identifying, selecting, and directing appropriate internal and/or external resources for effective claim evaluations, such as Subrogation, Risk Control, nurse consultants, and fraud investigators.

Verifies the nature and extent of injuries or property damage by reviewing relevant records and documentation.
Maintains claim files and documents activities according to established procedures.
Utilizes evaluation documentation tools in line with departmental guidelines.
Proactively reviews Claim File Analysis (CFA) for quality adherence and trend analysis.
Employs a diary management system to ensure timely handling of all claims. Evaluates liability and damages exposure at required intervals.
Establishes and maintains appropriate indemnity and expense reserves.
Recommends cases for discussion at roundtable meetings.

Participates in or presents at roundtables/authority discussions to share technical expertise, leading to improved indemnity and expense outcomes.

Actively shares knowledge of creative resolution techniques to enhance claim results for others.
Develops and implements innovative resolution strategies.
Timely and appropriately disposes of all claims within delegated authority.
Negotiates claim dispositions with insured parties and claimants or their legal representatives.
Recognizes and applies alternative resolution methods.
Manages litigated claims.

Develops litigation plans with staff or panel counsel, including discovery and legal expenses, to ensure effective resolutions and customer satisfaction.

Applies litigation management through counsel selection, evaluation, and direction of claim and litigation strategies.
Monitors and controls legal expenses to ensure cost-effective resolutions.
Effectively manages both allocated and unallocated loss adjustment expenses.
Attends depositions, mediations, arbitrations, pre-trials, trials, and other legal proceedings as necessary.
Updates relevant parties as needed, providing new information.

To perform essential job functions, obtaining and maintaining Insurance License(s) may be required to comply with state and organizational requirements.

Generally, licenses must be acquired within three months of starting the position, along with ongoing continuing education credits as mandated.

Performs other duties as assigned.

Qualifications/Responsibilities

Ideal Candidate Profile
Bachelor's Degree preferred.
3 years of experience in bodily injury liability claim handling and/or litigation.

Proficient in coverage, contract interpretation, liability and damages analysis, with a comprehensive understanding of the litigation process, relevant case law, and expert litigation management skills.

Extensive claims and/or legal experience with the technical expertise to evaluate severe and complex claims.
Able to make independent decisions on most assigned cases without supervisor involvement.
Thorough understanding of business line products, policy language, exclusions, ISO forms, and effective claims handling practices.
Open to the ideas and expertise of others, actively soliciting input and sharing ideas.
