Assistant Prosecutor

Position Title: Deputy States Attorney

The Deputy States Attorney is responsible for managing the prosecution of juvenile cases, including abuse and neglect matters, within Brookings County. This role also involves assisting law enforcement and community members with involuntary mental health commitments, as well as supporting the States Attorney and Chief Deputy in various adult criminal and civil cases.

• Manage a caseload primarily consisting of low-level felonies and juvenile cases.
• Assist law enforcement in mental health commitment processes.
• Engage in civil representation for the County.
• Prepare and present cases in legal proceedings.
• Conduct legal research and draft necessary legal documents.
• Review evidence and police reports to determine appropriate charges.
• Prepare and manage subpoenas for witnesses and documentation.
• Stay updated on relevant laws and proposed legislation.
• Communicate effectively with all parties involved in cases, including victims and law enforcement.
• Respond to public inquiries regarding legal matters.
• Represent the office at various public and inter-governmental events.
• Provide training to volunteers and law enforcement on legal processes.

Education and Experience:

Must possess a Juris Doctorate degree and be licensed to practice law in South Dakota, or be licensed prior to the start date. A background of 0-3 years in prosecution, litigation, or criminal law is preferred.
