The San Mateo County Bar Association is currently seeking qualified candidates for immediate and future vacancies in the role of Appellate Court Attorney. These positions will be filled at Level B, Level C, Level D, or Senior, depending on the qualifications of the selected candidates. Applicants who progress in the selection process will be required to complete a timed, in-house writing exercise.

KEY RESPONSIBILITIES
  • Assist in drafting bench memoranda and proposed opinions for assigned cases, as well as reviewing memoranda and opinions related to cases assigned to justices.
  • Conduct thorough evaluations and analyses of appellate briefs, trial records, and various legal documents.
  • Perform independent research on existing laws, legal issues, legislative history, and the intent behind specific statutes.
  • Draft and edit clear, concise, and well-organized memoranda and proposed opinions, adhering to assigned deadlines.
  • Provide written and oral recommendations concerning the resolution of legal issues presented before the court.
  • May involve work on Workers' Compensation, Public Utilities Commission, and other writ petitions.
  • Engage in other related duties as necessary.
MINIMUM QUALIFICATIONS

All levels require active membership in the State Bar of California.

In addition to the above requirement:

  • Level B: Equivalent to two years of post-bar legal experience.
  • Level C: Equivalent to three years of post-bar legal experience; or one year of experience as an appellate attorney, Level B, within the judicial branch.
  • Level D: Equivalent to four years of post-bar legal experience; or one year of experience as an appellate attorney, Level C, within the judicial branch.
  • Senior: Equivalent to six years of post-bar legal experience; or two years of experience as an appellate attorney, Level D, within the judicial branch.

Experience as a law clerk to a federal judge after passing the state bar but prior to formal state bar admission will be considered equivalent to post-bar legal experience.

Exceptional research, analytical, and writing skills are essential, along with a broad and practical understanding of the law. Familiarity with appellate practice, mature judgment, and the ability to collaborate effectively with colleagues are also crucial. Candidates should be able to discuss issues thoroughly and work independently while being open to supervision and feedback on their work product. A comprehensive knowledge of both criminal and civil law is preferred.

DESIRABLE QUALIFICATIONS

Additional experience beyond the minimum qualifications in legal practice, particularly as a judicial staff attorney or appellate practitioner, emphasizing legal writing and analysis, as well as experience in exercising adjudicatory skills.
