**Scope**:
The Director of Compliance and Privacy will serve as the company?s Compliance and Privacy Officer and will be responsible for building and managing a strategic, effective, and comprehensive privacy and compliance program, in compliance with the Health Insurance Portability and Accountability Act of 1996, Public Law 104-1911 (?HIPAA?), as amended and extended by the Health Information Technology for Economic and Clinical Health Act, Public Law 111-005, the implementing regulations at 45 C.F.R. Parts 160, 162, and 164 promulgated by the United States Department of Health and Human Services (?DHHS?), along with any guidance or regulations issued by DHHS, and other applicable laws;. This includes developing, implementing, and maintaining policies and procedures that enable consistent, effective practices. The incumbent will work to minimize risk and ensure the confidentiality of protected health information (?PHI?) and electronic protected health information (ePHI). In addition, the incumbent will promote a culture of privacy and compliance throughout the MedWatch organization and be a key partner to ensure compliance with Utilization Review Accreditation Commission (URAC) standards. This position is remote; however, the incumbent must be located in the state of Florida, preferably in the Orlando/Lake Mary metro area.

**Education**:
? Bachelor?s degree required in health administration, business administration, or
related field, as well as a Juris Doctor and member of a state bar.

**Licensure/Certification Requirements**:
? Certified Healthcare Compliance (CHC), Healthcare Privacy Compliance (CHPC) preferred.

**Experience**:
? A minimum of five (5) years of healthcare compliance experience.
? Previous experience in a top compliance role preferred.
? Previous experience participating in the preparation, on-going policy and procedure development and evidence collection for URAC Accreditation preferred.
? Experience with HealthCare Compliance Program Management.

**Requirements/Skills**:
? Expert level knowledge of statutes, rules and regulations pertaining to healthcare compliance and privacy.
? Strong understanding of accreditation standards and best practices in healthcare compliance and privacy.
? Excellent communication, collaboration, and interpersonal skills with the ability to influence and motivate staff at all levels.
? Proven ability to develop and deliver effective training programs.
? Strong analytical and problem-solving skills.
? Computer skills including MS Office, Teams, and SharePoint.

**Duties and Responsibilities**:
? Will serve as the organization?s Compliance and Privacy Officer.
? Will serve as an expert advisor on compliance and privacy related matters providing guidance to senior leadership and ensuring alignment with Program objectives.
? Lead and oversee the advancement and on-going management of the organization?s privacy and compliance programs.
? Maintain current knowledge of applicable federal, state and local laws and regulations.
? Advise the organization on applicable regulatory privacy and compliance requirements.

**? Chair the Compliance Oversight Committee which entails**:

- Provide regular reports detailing privacy and compliance initiatives and status of activities to committee members and senior management.
- Identify and present regulatory changes and matters of significance or urgency to the attention of senior management.
- Recommend compliance process improvements.
- Develop, update and submit policies and work plan(s) for committee review and approval.
? Manage the development, delivery and completion of privacy and compliance training programs. Review and update training materials. Create and deliver specialized educational programs for key roles and responsibilities.
? Develop, implement, review, update and maintain compliance and privacy related policies and procedures as appropriate.
? Conduct an Organizational annual privacy, security and compliance risk analysis and on-going monitoring activities.
? Participate in internal and external audits related to privacy, security and compliance practices. Oversee the implementation of corrective actions.
? Responsible for receiving, tracking, documenting, and investigating reports of potential privacy or compliance-related incidents or complaints. It will be expected the incumbent will take prompt action to resolve the findings. Direct the process for reporting incidents as required by law and/or applicable contractual obligations.
? Participates in the vendor vetting process and conducts ongoing assessment to review vendor compliance with applicable privacy/compliance federal and state regulatory requirements.
? Analyze client, vendor and other third-party requests for disclosure of PHI, identify and issue appropriate privacy-related agreements (e.g., Business Associate Agreement, Non-Disclosure Agreement). Review, draft and negotiate privacy related agreements. Maintain an agreement database.
