Position Summary
We are searching for a high-performing, high-potential attorney to join our electric and natural gas energy practice. The successful candidate will possess demonstrated ability to learn, discern, collaborate and execute to accomplish defined goals. We want an individual who can provide holistic legal support to internal business teams through direct engagement, relationship-building, problem-solving and recruitment of specialized legal support as needed.
This role primarily will provide legal support for Duke Energy's regulated electric wholesale portfolio, which includes advising on, negotiating, drafting and securing regulatory approval for long-term wholesale power purchase agreements between Duke Energy and its wholesale customers in all jurisdictions. In addition, the role will support our natural gas business unit and fuels procurement teams in federal natural gas matters and litigation. Additional responsibilities will include providing legal advice to management on complex matters, managing outside counsel and consultants as needed, and coordinating and collaborating with other attorneys and business clients.
FERC expertise and overall energy experience are required. A strong candidate will show a willingness to be cross-trained across the state and federal energy landscape to expand their legal expertise. Furthermore, we want an individual with a sincere curiosity of the rapidly evolving energy sector and the role of Duke Energy within it. Therefore, a successful hire will work diligently to understand the company and industry.
The Associate General Counsel will work under the direction of Brian Heslin, the Deputy General Counsel over FERC and natural gas regulatory. Experience working within teams to accomplish strategic goals are important. The candidate should have strong people and writing skills as well as the ability to quickly master complex legal and regulatory issues.
Responsibilities
- Negotiate, draft, and interpret contractual language regarding wholesale power sale arrangements.
- Examine, interpret, and advise on FERC laws, rulings, regulations, orders, standards, and requirements.
- Review, analyze, and investigate legal implications, both commercial and regulatory, with respect to business decisions and events.
- Represent the company in FERC natural gas proceedings, including Section 4 and Section 5 rate cases.
- Identify regulatory or external customer/stakeholder issues, particularly with respect to FERC, and proactively develop positions in order to work with teams (including cross functional teams) to achieve desired results.
- Prepare contracts, testimony, briefs, arguments, pleadings, and other legal documents.
Working Conditions
- Hybrid - Work will be performed from both remote and onsite locations after the onboarding period. However, hybrid employees should live within a reasonable commute to Duke Energy Charlotte, NC or Washington, DC offices. The in-person portion will be located in Charlotte, NC or Washington, DC.
- Local and overnight travel approximately 15% of the time.
Required/Basic Qualifications
- Doctor of Jurisprudence degree (JD) from an accredited law school.
- Minimum of Seven (7) or more years of experience practicing law.
- Licensed to practice law in North Carolina or Licensed to practice in any state in the US and eligible for admission under NC bar rules.
Desired Qualifications
- Utility regulatory/agency experience.
- Effective litigation experience and skills.
- Experience in a government, law firm or corporate law department.
- Contract negotiation/interpretation/preparation experience.
- Experience in FERC proceedings.
- Experience in organized markets.
- Effective legal research and writing skills.
- Experience in interacting with multiple stakeholders/collaborative groups in reaching multi-party resolutions.
- Ability to work independently and with a group of people for long hours under deadline pressures.
- Broad, in-depth knowledge and experience in the energy industry.
- Knowledge of accounting.
- Knowledge of Duke Energy and its various business operations.
- Strong, effective communication, interpersonal and presentation skills.
