TheDirector of Legal Affairs plays two important roles. First, by assisting theGeneral Counsel in legal and risk management matters, and second, by sharingresponsibility for ethics complaints and arbitration requests. Key dutiesinclude assisting the General Counsel with contract review and organization, maintenanceof governing documents and policies, processing ethics complaints andarbitration requests through the hearing process, drafting hearing paneldecisions in ethics cases, and responding to inquiries regarding ethical andprofessional conduct. This position works in close collaboration with theDirector of Professionals Services and the Professional Standards + ComplianceSpecialist.

Specific Responsibilities:

Legal Affairs:

  • Assists General Counsel in managing legal affairs for MIBOR and MSC.
  • Maintains MIBOR and MSC governing documents, including Articles of Incorporation, bylaws and policies, and ensure published versions are current.
  • Assists General Counsel with legal research, brief writing, litigation monitoring and responding to subpoenas or other discovery requests.
  • Assists General Counsel with review of contracts and agreements.
  • Assists General Counsel with all matters related to the Risk Reduction Committee.
  • Provides administrative support to General Counsel, including file organization, scheduling, scanning, correspondence, project management and contract tracking/management.
  • Shares responsibility for the coordination of the ethics and citation complaint, arbitration, and mediation processes. Serves as back up liaison to the Professional Standards Committee.
  • Shares responsibility for assembling hearing panels and notifying parties of relevant processes in preparation for ethics and arbitration hearings.
  • Shares responsibility for processing ethics complaints and arbitration requests forwarded by Grievance and shepherding these dockets through the hearing process. This includes communicating with the parties, the chair and panelists, processing and distributing evidence, drafting and disseminating all required notices and forms and all other tasks necessary to ensure efficient hearings.
  • Shares responsibility for attending ethics and arbitration hearings and drafting hearing panel decisions for review by General Counsel.
  • Shares responsibility for post-hearing communications, including dissemination of written decisions and ratifications to the parties. Assists with coordination of appeals and procedural reviews.
  • Serves as back up to Director of Professional Services and Professional Standards & Compliance Specialist.
  • Researches and stays abreast of changes, trends and scams in the real estate field, particularly the needs of practitioners and prepares for publication related articles.
  • Writes articles and develops other strategies for communicating ethics and best practices for business conduct.
  • Assists other departments by contributing to relevant trainings and professional development, including New Member Orientation, New Broker Orientation, the Real Estate Academy of Leadership and my board master professional certification programs.
