Position Summary

This position has a dual role. The primary role is as a Residential Child Care Monitor who conducts onsite monitoring of residential care facilities following specific guidelines and protocols as set forth by the Appleseed Court Monitors. The Residential Child Care Monitor, (“Monitor”), participates as a investigating the care provided to foster children who are under the permanent managing conservatorship of the Texas Department of Protective and Regulatory Services and placed in 24-hour residential childcare facilities. While conducting monitoring visits of the residential childcare facilities, the Monitor will utilize his or her expertise and independent professional judgment in conducting investigations and interviews of children and staff to determine and document the facility’s compliance with the Court Orders in M. D.; bnf Stuckenberg, et al v. Abbott for the Appleseed Court Monitors.

The secondary role is as an Investigation Attorney is responsible for investigating and identifying abuse, neglect, and rights violations, providing legal services and determining eligibility for Disability Rights Texas client services within agency policies and priorities – as it generally relates to the assigned team. This includes interviewing clients, reviewing records, conducting legal research, writing administrative complaints, negotiating outcomes, mediating disputes and representing clients in administrative hearings and in state and federal judicial proceedings. This position provides legal assistance, direction and supervision of the Advocate’s casework, when appropriate. The Issue Team Attorney also provides education and training sessions about the legal rights of people with disabilities for people with disabilities, parents, advocates, and professionals/service providers and the community.

The Monitor uses advanced program knowledge and expertise to independently evaluate compliance with licensing requirements, rules, regulations and policies and procedures used by facilities. The Monitor will participate in on-site monitoring visits of facilities and perform a comprehensive review of the facilities to evaluate compliance with the court orders in M.D., bnf Stuckenberg, et al. v. Abbott. The Monitor will be responsible for independently entering data in the Appleseed Court Monitor’s automated reporting system. The Monitor will interact routinely with administrative and professional staff of private and public facilities and child placing agencies. Person employed in this position must be cleared through a thorough and invasive background investigation conducted by the U.S. Marshall’s Office. This position handles highly confidential information. The monitor shall not disclose any confidential information about any foster youth, the facilities or the monitoring visit that was obtained during the course of a monitoring visit with any DRTx staff who are not members of the monitoring team. The Monitor/Team Attorney works entirely independent of others in the Organization.

Physical/Mental Requirements

  1. Uses personal computer approximately 6-7 hours per day.
  2. Uses telephone and email to communicate with team members and other professionals; approximately 3-5 hours per day.
  3. Sits approximately 6-7 hours per day.
  4. Requires working under a moderate degree of stress (time constraints; deadlines; multitasking high-level projects and issues; complex issues; and conflict resolution).
  5. Extensive travel (three to four consecutive days monthly) within Texas, is required – often to remote rural locations.
  6. Work in a mobile environment (the majority of work is performed outside of the office environment) under a moderate degree of stress (time constraints, deadlines, complex issues; institutional settings; and conflict resolution).
  7. Ability to work more than 8 hours per day on consecutive days including early mornings once a month (2:00 am-4:00 am) during on site monitoring visits.

Required Qualifications

  1. Law Degree plus Texas Law License with 1-5 tears experience
  2. Provide legal services and advice to individuals eligible for Disability Rights Texas services which may include legal advocacy, negotiation, mediation, litigations and handling of administrative and court proceedings.
  3. Provide direction and technical assistance to Advocates, when appropriate. Will participate in case reviews and provide Advocates with direction on strategizing cases and legal issues, when appropriate.
  4. Implement agency's client services policies and procedures regarding client interviews, case records, investigations, case advocacy and case files.
  5. Develops and/or maintains ongoing caseload within the level established by the agency's client services policies and procedures and meets expectations for litigation.
  6. Strong and effective writing, verbal, and negotiating communications skills including the ability to do so in a concise manner, even when doing so regarding complex issues to a variety of people.
  7. Demonstrated effective written and oral communication skills including the articulation of well thought out arguments; drafting complaints, briefs, memorandums of law and other pleadings; conducting depositions and other discovery methods; engaging in negotiations and settlement discussions; writing demand letters and other correspondence.
  8. Demonstrated knowledge of complex state and federal rights protection statutes, laws and regulations.
  9. Excellent interpersonal, relationship-building and collaboration skills to be able to work effectively with others inside and outside of the organization; relationship builder with the flexibility and finesse to “manage by influence”.
  10. The ability to take direction and independently follow through on all instructions.
  11. The ability to research, analyze, and disseminate relevant issues and apply information effectively.
  12. Willingness and ability to travel three to four consecutive days monthly , even to remote rural locations.
  13. Excellent detail-orientation, follow-up skills and organizational skills plus the ability to multi-task and work under challenging conditions while meeting deadlines.
  14. Knowledge and skills to appropriately implement instruction.

  19. Knowledge and skills to appropriately monitor residential child care facilities.
  20. Ability to multitask, prioritize conflicting assignments, and work under challenging conditions while meeting required deadlines.

  25. Demonstrated knowledge of intellectual disability, emotional disturbance, physical disabilities, development disabilities, and trauma-informed treatment as applied to children.
  26. Demonstrated knowledge of interviewing techniques, especially of children.
  27. Skill in assessing immediacy of harmful situations, which might result in the physical or psychological injury or death to a child.
  28. Ability to evaluate investigation records in relation to the Texas Department Family and Protective Services standards for quality.
  29. Ability to analyze reports and produce comprehensive documents regarding findings.
  30. Skill in establishing and maintaining effective working relationships.
  31. Skill in effective verbal and written communication.
  32. Ability to maintain a high level of confidentiality.
  33. Ability to manage hostility and resistance to regulation in a professional, non- defensive manner.

Preferred Qualifications

  1. Bilingual in English/Spanish – both in written and spoken communication.
  2. Experience investigating or monitoring facilities for compliance with laws, rules, policies and procedures.
