The litigation attorney position works under the direction of the MLDP General Counsel and is responsible for the defense of lawsuits submitted by Arkansas cities to the Municipal Legal Defense Program (MLDP).
ESSENTIAL DUTIES AND RESPONSIBILITIES include but are not limited to the following:
- Litigation that includes the defense of land use cases; the defense of employment discrimination, harassment, and retaliation cases arising under Title VII, the ADA, ADEA, FLSA and FMLA, along with respective Arkansas state law counterparts; and a variety of civil and constitutional – both federal and state – rights claims, primarily claims of police misconduct, First Amendment retaliation claims and whistleblower retaliation claims.
- Occasional defense of a motor vehicle case, with attendant subrogation work, or a workers’ compensation case.
- In-state travel for a variety of purposes.
- Attend client meetings and council meetings as needed.
- Investigate claims, interview witnesses, and gather documents.
- Prepare for and conduct depositions, including travel to various Arkansas Department of Correction Facilities.
- Counsel and advise municipal clients on a variety of matters.
- Negotiate settlement of claims and cases.
- Facilitate and attend settlement conferences and mediation hearings.
- Prepare for, attend, and participate in court hearings, bench trials and jury trials.
- Respond to inquiries and aid clients in a variety of matters, for example, drafting a city’s response to an EEOC charge or assisting in the drafting of a request for information from the Department of Workforce Services.
- Give presentations on a variety of legal matters at the League’s Annual Winter Conference and Summer Convention.
- Appeal coverage decisions to the Executive Director and/or Municipal League Defense Program Steering Committee.
- Other duties that may be assigned.
