Overview

The Director of Compliance is responsible for creating and implementing the compliance program to prevent and detect illegal, unethical, or improper conduct. The Director of Compliance develops and implements policies and procedures to ensure compliance with rules and regulations that are applicable to pharmacies such as FDA, OIG, DEA, CMS, OSHA, HIPAA, and each of the State Board of Pharmacy. The Director of Compliance will report to the CEO and is responsible for the company’s overall compliance function.


Key Responsibilities

  • Ensures that the compliance program meets the needs of the company, with a focus on CMS Payor compliance, professional and facility licensure compliance, pharmacy practice compliance and record retention management.
  • Developes and implements policies and procedures that demonstrate compliance with federal and state regulatory rules and regulations governing all pharmacy commercial matters.
  • Advises and approves all communications related to the Company’s compliance incidents, such as breach of privacy violations and State Board citations, to ensure they are addressed appropriately and directs corrective actions to rectify issues of non-compliance.
  • Creates standard operating procedures for audits and accreditations, disseminates findings, develops a compliance workplan, and gains buy in from leadership to achieve regulatory compliance goals.
  • Directs execution of the enterprise-wide employee compliance training program.
  • Oversees and monitors payor contract adherence and required reporting of quality and compliance metrics.
  • Travel to pharmacies to evaluate local practices for compliance.
  • Manages relationships, inquiries and communications with all regulators including the FDA, DEA, and Boards of Pharmacy in all 50 states.
  • Revises and implements pharmacy policies for the Company as state and federal regulations evolve, ensuring business processes satisfy state, federal, and DEA requirements.
  • Responds to and addresses alleged violations of rules, regulations, policies, and procedures by overseeing investigations, informing executive management, and recommending the necessary actions to prevent further violation.
  • Continuously monitors the state and federal legislative landscape to stay informed on proposed laws, rules, and regulations that the Company must follow.
  • Reviews and interprets the proposed new laws, rules and regulations and provides frequent updates and summaries to executive management and the Board on identified risk areas or red flags, setting a tone of compliance at the top.
  • Establishes and chairs compliance committee(s) to evaluate the effectiveness of the Company’s compliance program and any alleged violations of such program.
  • Ensures proper reporting of violations to duly authorized enforcement agencies as appropriate or required.


Skills & Experience

  • Minimum of 6 years experience in the health care field.
  • 8 years of professional experience in compliance function.
  • Experience in pharmacy compliance is strongly preferred.
  • MS/MBA/JD preferred.
  • Experience monitoring state and federal pharmacy laws for changes that will impact the operations of the organization.
  • Experience working with State Boards of Pharmacy to resolve issues and represent the organization.
  • Familiarity with legal language, pharmacy law, CMS requirements, and industry standards.
  • Ability to stay current on state and federal regulations.
  • Ability to analyze, implement, and advise appropriate practices for contract management.
  • Ability to travel to pharmacy locations required.
