There is an exciting opportunity within the Criminal Division of the Office of the Attorney General (OAG) to lead the Medicaid Fraud Control Unit (MFCU). The position of First Assistant Attorney General is designated as the Director of the federally mandated MFCU.This position oversees complex fraud investigations and criminal and (occasionally) civil prosecutions of Medicaid provider fraud; fraud in the administration of the Medicaid program; and abuse, neglect, and exploitation of patients in residential care facilities receiving payment under Medicaid.

The MFCU includes attorneys, analysts, and law enforcement agents. The unit also coordinates with the state’s Medicaid Inspector General and the OAG’s Civil Division. The Director must be able to work with this diverse group of professionals to efficiently achieve measurable results with an effective anti-fraud program.

The OAG expects its First Assistant AGs to be active litigators and to keep their courtroom skills sharp. The successful candidate will have an exemplary record as an ethical litigator and a vision to improve and expand the MFCU’s work.

Duties include, but are not limited to:

Supervising a team of capable professionals with diverse skills and expertise to ensure matters are consistently investigated and prosecuted proactively, efficiently, and with reasonable speed. Developing and administering a Medicaid anti-fraud program to meet federal performance standards and financial and statistical reporting requirements, in order to and achieve annual federal recertification. Properly prioritizing investigations consistent with the Attorney General’s goals and priorities. As directed by the OAG, communicating with and serving as contact for U.S. Department of Health and Human Services, National Association of Medicaid Fraud Control Units (NAMFCU), Kansas Department of Health and Environment, Kansas Department for Aging and Disability Services, Kansas Department of Children and Families, HP Enterprise Services (Medicaid fiscal agent), and other local, state, federal, and private bodies involved in the Medicaid program. Ensuring unit is adequately trained and maintains competency regarding changes to statutes, regulations, policies, and procedures related to Medicaid, long-term care, health-care fraud, and criminal procedure. Participating as member of global settlement negotiation team in inter-jurisdictional national health care fraud investigations, as requested by NAMFCU and authorized by the OAG. Developing and presenting public education information/training to law enforcement, health care providers and civic organizations concerning Medicaid fraud and abuse. Maintaining a criminal caseload consistent with the Director’s other duties.

Qualifications

Licensing & Certification

Membership in good standing with the Bar of the Supreme Court of Kansas or eligible for admission without examination. A valid driver’s license

Minimum Qualifications

At least four years of experience as a state, federal, or military criminal prosecutor

Preferred Qualifications

Prior experience supervising attorneys or related staff (e.g., investigators, legal secretaries, analysts) At least eight years of experience as a state, federal, or military criminal prosecutor Significant experience litigating cases involving government benefit fraud, false claims, or similar issues in administrative, civil, or criminal courts. Working knowledge of Medicaid program. Post-Offer, Pre-employment Requirements

As a condition of employment, candidate(s) are subject to a pre-employment screening process to include a fingerprint and name-based criminal history records check and reference/background check of past and present employers. The pre-employment screening process will be waived for current OAG personnel who have previously completed the screening requirements.

In this position, you would be authorized access to private information to the extent necessary to perform the assigned duties. Employees must be cautious not to release this information to the public or other individuals, including but not limited to OAG employees who have not been authorized or who do not have a legitimate organizational, departmental, or business need to know.
