POSITION DUTIES

A Health Occupations Investigator III (HOI) III is the lead investigator in conducting confidential investigations of licensed physical therapy practitioners who have had complaints filed with the Board of Physical Therapy Examiners on alleged violations of the Maryland Physical Therapy Act.� The Lead Investigator is assigned the more technical, sensitive, and complex investigations and provides technical guidance, direction, and training to other investigators in investigatory procedures and techniques.\r

The HOI III gathers and evaluates factual information and information garnered from complainants, witnesses, and respondents, prepares and serves subpoenas for obtaining physical or documentary evidence and secures evidence such as medical records, diagnostic tests, photographs, video, etc. prepares clear, comprehensive, and detailed investigation reports so that the Board of Directors may make informed decisions regarding alleged violations of the Maryland Physical Therapy Act for possible referral to the Attorney General's Office for prosecution. The Lead Investigator provides the Attorney General's prosecutor's office with the information necessary to determine what actions to take as a result of the Board's referral.\r

The HOI III determines strategies necessary in compliance, complaints, and investigations, and identifies alternative resolutions where indicated, should have clear and concise communications relevant to duties utilizing the Board's standardized operating procedures. The Lead Investigator follows up after investigative sanctions have been lifted if requested or required and demonstrates the ability to quickly and accurately retrieve investigative information if called upon to testify at formal and informal hearings.�\r

The HOI III should have a working knowledge of administrative law processes, interviewing, and investigative techniques, advanced knowledge of the Maryland Physical Therapy Act, the Health Insurance Portability and Accountability Act (HIPAA), and the Freedom of Information Act. possess skills to ascertain facts through in-person or telecommunication interviews and observations. The HOI III should possess excellent time and project management skills, have experience making independent problem-solving decisions and possess the ability to multi-task. A professional demeanor and excellent communication skills are a must as well as the ability to work with the public with tact, understanding, fairness, without bias, and good judgment.\r

The Health Occupations Investigator III, at full performance level, leads and guides other investigators as needed, demonstrates leadership and proactivity to ensure continuity of operations. The HOI III receives supervision from the Health Occupations Investigator Supervisor (Compliance Administrator).\r
This position is eligible for hybrid telework which is subject to approval from the supervisor.\r

MINIMUM QUALIFICATIONS

Experience:�Seven years of experience conducting criminal investigations, including the preparation of analyses and�reports for use in legal proceedings.\r

1. Candidates may substitute the possession of a Bachelor's degree in the field of criminal justice, criminology, law enforcement or an allied health field, (such as nursing, pharmacy, psychology, social work, nutrition, dietetics,�speech pathology, audiology) from an accredited college or university and three years of experience conducting criminal�investigations, including the preparation of analyses and reports for use in legal proceedings for the required�experience.\r
2.�Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer in�Investigator, Police and�Intelligence�Specialist�classifications or Investigator, Police and�Intelligence�specialty codes in the criminal�investigation field of work on a year-for-year basis for the required experience.��\r
