Principal trial attorney for the Center for Military History (CMH) and the secondary attorney for all matters relating to civilian personnel, labor relations, equal employment opportunity, and arbitration cases arising within CMH and TRADOC.
Incumbent determines case strategy and tactics; prepares prehearing motions and petitions; identifies relevant witnesses and documents via discovery procedures, including interrogatories and depositions.
Assists in judicial review of administrative decisions in coordination with attorneys from HQDA Labor and Employment Law Division and Litigation Division of the Office of The Judge Advocate General, and the Department of Justice.
Conducts settlement negotiations with opposing counsel, drafts settlement agreements, coordinates with commanders and directors on the meaning of settlement terms and executes settlement agreements.
Acts as the Command representative responsible for appeal preparation and presentation of the CMH or TRADOC position.
Develops the Command position on litigation issues that arise in conjunction with federal court and administrative tribunal proceedings.
Performs action attorney functions in providing legal advice and written reviews in the areas of the general military administrative law.
Provides oral and written advice and technical legal guidance to key CMH, TRADOC officials, and commands, upon request, concerning all aspects of the law of administrative law; and federal employment and federal labor-management relations.
Assists with the Installation Ethics program by issuing advisory opinions on matters involving conflicts of interest, misuse of government position, outside employment and other activities, gifts from outside sources/prohibited sources, etc.
Incumbent is required to be expert in the various statutes and regulations that govern employee official conduct and financial disclosure.
Provides instruction to employees in all aspects of government ethics and supervises the annual and new entrant financial disclosure process.
