Job Description

We are seeking a highly skilled and motivated Constitutional Claims Litigation Attorney to join our dynamic legal team. The ideal candidate will have demonstrated expertise in constitutional law, with a focus on the emerging field of federal court oversight of administrative agencies, and a passion for advancing the principles of separation of powers, due process, and individual rights in the face of regulatory overreach.

This role involves representing a client in high-stakes litigation that challenges the authority and practices of federal and state administrative agencies. The attorney will work on groundbreaking cases at the intersection of constitutional and administrative law, including claims related to the Seventh Amendment right to a jury trial, due process violations, statutory interpretation challenges, and the application of recent Supreme Court precedents like SEC v. Jarkesy, Axon v. FTC, and Loper Bright Enterprises v. Raimondo.



Key Responsibilities
  • Litigation Strategy: Develop and execute litigation strategies for constitutional claims involving administrative agency, focusing on issues like due process violations, unlawful delegation of powers, improper statutory interpretation, and agency overreach.
  • Case Management: Represent client in federal district and appellate courts, including filing constitutional challenges to agency actions under precedents like Jarkesy, Axon, and Chevron's declining deference.
  • Legal Research & Analysis: Conduct in-depth research on constitutional doctrines, federal statutes, and administrative regulations, with an emphasis on emerging trends in judicial oversight of agencies.
  • Brief Writing & Oral Advocacy: Draft persuasive briefs, motions, and pleadings; deliver oral arguments before federal courts; and prepare for hearing and trial.
  • Client Counseling: Advise client on the strategic implications of administrative agency actions and provide guidance on constitutional and statutory remedies.
  • Thought Leadership: Monitor and analyze developments in administrative law and constitutional litigation; contribute to thought leadership through publications, presentations, and media engagement.
  • Cross-Functional Collaboration: Work closely with regulatory attorneys, compliance professionals, and policy experts to address agency rulemaking and enforcement challenges.


Qualifications
  • Education: Juris Doctor (J.D.) degree from an accredited law school.
  • Bar Membership: Admission to practice law in at least one U.S. jurisdiction; federal court admission preferred.
  • Experience:
  • 5+ years of litigation experience, with a strong emphasis on constitutional law, administrative law, or federal court litigation.
  • Experience litigating claims involving federal agencies (e.g., USPTO, SEC, FTC, EPA) is highly desirable.
  • Knowledge:
  • In-depth understanding of constitutional principles, including the Seventh Amendment, Fifth Amendment due process, and separation of powers.
  • Expertise in Supreme Court precedents like Jarkesy, Axon, and Loper Bright, and familiarity with the implications of the Chevron doctrine's decline.
  • Skills:
  • Exceptional legal writing and oral advocacy skills.
  • Strong analytical and strategic thinking abilities.
  • Proven ability to manage complex, high-stakes litigation.

Preferred Qualifications
