Job Summary
The Arizona Attorney General's Office Civil Litigation Division/Consumer Protection Advocacy Section is seeking a Senior Litigation Counsel to identify, evaluate, and investigate possible consumer fraud and related unlawful conduct, and to bring related civil enforcement actions on behalf of the State of Arizona.

Remote Options: This position may be eligible for Remote Work two days a week.

Job Duties
This Senior Litigation Counsel position will assume responsibility for investigations, civil enforcement actions, and other assignments, and also serve as a section resource, providing advice, information and support to other attorneys, staff and management. This position will be expected to mentor and advise newer, less experienced attorneys in conducing civil investigations and enforcement actions, including providing those attorneys with advice, consultation, work review, and co-counseling.

This position will develop section cooperation to enhance the Office's ability to respond to litigation emergencies and participate in major litigation. Assigned litigation matters will include, but are not limited to, complex consumer fraud actions in state and federal court.

This position will also provide written and oral legal opinions and advice on a wide variety of legal and policy issues that arise in the Consumer Protection and Advocacy Section, and assist the Office in legislative and community education efforts.

This position will participate and coordinate with other attorney general offices in multi-state litigation and other activities, and may also be assigned to work on executive committees for multi-state litigation.

Knowledge, Skills & Abilities (KSAs)

  • Knowledge of civil procedures, filing deadlines, completing matters on a timely basis, producing professional pleadings and keeping abreast of new statutes and case law.
  • Knowledge and understanding of applicable consumer fraud statutes, other Arizona statutes, federal laws relating to consumer issues and the rules and regulations of state and federal courts.
  • Knowledge of legal techniques and the basic concepts of American Jurisprudence and of the formats utilized in the preparation of legal documents.
  • Knowledge of the practical factors that impact investigative and litigation decisions and goals, including target and defendant responses, opposing counsel strategies and judicial perspectives, and victim/witness considerations.
  • Knowledge and experience with settlement negotiations and financial considerations for the state and defendants.
  • Skilled in legal and factual issue analysis, legal research, legal writing, oral presentation and negotiation.
  • Skilled in advocacy, public speaking, media communications, trial skills, negotiating skills, investigative skills, and the ability to work closely with law enforcement personnel as well as witnesses.
  • Skilled in identifying issues and preparing concise analysis of legal documents and records.
  • Skilled in preparing legal briefs, memoranda, and correspondence efficiently and with a minimum of supervision.
  • Ability to interact with and obtain information from witnesses, representatives of state and federal agencies and the courts.
  • Ability to use situation-appropriate interpersonal communication, good judgment, and high ethical and professional standards.
  • Ability to function well under time constraints and other pressures.
  • Ability to type and operate software and equipment that is common to a modern work environment.

Selective Preference(s)
At least five years of civil litigation experience.

Experience representing plaintiffs in complex civil litigation.

Pre-Employment Requirements

  • Travel is required for this position. A valid Arizona Driver's License is required, along with consent to have your driving record run periodically.
  • Admission to, and good standing with, the Arizona State Bar is required (include on resume the date(s) of admission in Arizona and any other states). Candidate must have an active Arizona State Bar license.
  • Attorney applicants are required to submit a writing sample with their resume/application profile.

The writing sample should contain an analysis of some substantive legal issue and provide insight concerning your ability to think and to explain and advocate for a particular position.
