About the job Bankruptcy Clerk
The primary purpose of this position is to research consumer bankruptcy cases filed
in the Eastern District of Texas (Beaumont & Lufkin Divisions) and review
bankruptcy schedules & statements for outstanding taxes. The clerk will input data
and update coding into BankTool and Tax Tool. The clerk will prepare and e-file
Notices of Appearance and Proofs of Claims as needed. The clerk will also monitor
checks from all bankruptcy cases and prepare a memo of instructions for clients on
how to post payments. If a bankruptcy case becomes delinquent in plan payments, the
clerk will prepare a letter of Plan Default. This will require the ability to read and
understand bankruptcy plans, and orders, and calculate interest amounts to determine
whether there is a default. Defaults in business cases will be coordinated with
the business Bankruptcy Team. If the default isn't cured timely, then the Clerk will
prepare a Notice of Plan Default to be filed with the Court
Bankruptcy Payments: Monitor payments received from all bankruptcy
cases. Review the check, BankTool, bankruptcy plans, and confirmation
orders to determine how the payment should be applied. Draft memos of
instructions to clients on how to post the payments. Coordinate with the
Business Bankruptcy Team (Business Paralegal, BK Manager, Attorneys).
2. Plan Defaults: Monitor Chapter 11 Post-Confirmation cases for plan defaults
by reviewing BankTool, bankruptcy plans, and confirmation orders. Confirm
defaults by coordinating with the Business Bankruptcy Team.
3. Plan Defaults: Research payment applications by clients and compare to
required plan payments. Create spreadsheets to manage payment schedules
and defaults.
4. Plan Defaults: Draft letters of Plan Default to defaulted debtors. Set calendar
ticklers to follow up on deadlines to cure defaults.
5. Plan Defaults: Draft Notice of Plan Default pleadings on cases that have
failed to cure defaults.
6. Plan Defaults: Uncode cases in BankTool and TaxTool on accounts that are
in Final Default. Communicate with appropriate firm staff that collections
may proceed.
7. Research: Research all consumer bankruptcy cases filed in Eastern District
of Texas (Beaumont & Lufkin Divisions) for outstanding taxes owed to
clients. This includes review of schedules, statements, and all amendments
thereto. This may include research through CM/ECF or PACER.
8. Research: Communicate and follow up with various staff from other firm
offices and tax client contacts for tax information, following up on non-
responses.
9. Research: Input new case data into BankTool.
10. Research: Draft Notices of Appearance and Proofs of Claim. Amend prior
Notices of Appearances and Proofs of Claim as needed.
