Description: Position Summary:Under the direction of the Office of the General Counsel (OGC), the Risk Management and Compliance Attorney provides legal support, as well as analysis and support on the implementation of Federal and State regulations and policies having significant financial, procedural or policy consequences and of major important to the New York City Public Schools (NYCPS), General Counsel, Executive Deputy Counsels, Deputy Counsel, and Senior NYCPS officials, which have the potential for broad impact on the education policy and goals of the school system, with an emphasis on the provisioning and delivery of transportation services. Performs related work. Reports to:Deputy Counsel, Risk Management, Regulatory Compliance, Federal Affairs and Student Support Direct Reports: N/A Key Relationships: General Counsel, Executive Deputy Counsel, Deputy Counsel, NYCPS attorneys, Office of Pupil Transportation, bus vendors, Special Education Office, Office of Non-Public and Charter Schools, Law Department, and other internal and external offices as assigned. Responsibilities Provides level advice, guidance and support to program offices, including the Office of Pupil Transportation. Performs legal research, prepares legal memoranda for attorneys and NYCPS officials, and makes recommendations. Reviews new and existing student transportation and other policies, procedures, and documents to ensure legal sufficiency. Analyzes and responds to issues. Drafts and updates transportation-related policies, rules and regulations, and other regulations and policies as directed. Reviews RFP's, proposals, and contracts, and recommends solutions to mitigate project risks. Reviews and advises on applicable laws and Chancellor’s Regulations and how they relate to new and existing programs, including but not limited to transportation programs. Develops and supports training requirements. Advises on Office of Special Investigations referrals. Handles vendor hearings and appeals for Office of Pupil Transportation issued violations and liquidated damages. Qualification Requirements: Minimum Admission to the New York State Bar; and either 2 or 3 below. One year of satisfactory United States legal experience subsequent to admission to any state bar; or Six months of satisfactory service as an Agency Attorney Intern (30086). Note: In addition to meeting the minimum Qualification Requirements: To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. Note: Selected candidates must remain members of the New York State Bar in good standing for the duration of their employment. Plus In addition to meeting the minimum requirements, individuals must have two additional years of the experience described in "1" above Preferred Ability to write clearly, concisely and make sound decisions based on evidence. Ability to rapidly understand provisions of applicable law and regulations. Experience in transportation, contracts, and/or education law. Ability to rapidly understand provisions of applicable law and regulations. Efficient research, analytical and communication skills. Ability to conduct or coordinate highly complex legal research efficiently and on tight deadlines. Ability to advise and render legal opinions on educational policies and practices. Ability to rapidly understand provisions of applicable law and regulations in a fast-paced environment. Excellent communication and interpersonal skills. Salary: $106,607 - $111,107 (Internal candidates who are selected for this position and who currently hold comparable or less senior positions within the DOE will not earn less than their current salary.)
