Duties Description Reporting to the Director of Human Resources Management, Director of Human Resources 5, the Associate Director Human Resources 3 (Labor Relations), M-3, will function as the Director of the Employee Relations Bureau, and develop, maintain, and administer the Office of Parks, Recreation, and Historic Preservation’s (OPRHP) rules and policies, the employee disciplinary and grievance processes, and the drafting and facilitation of employee counseling.Duties of the position include, but are not limited to: • Perform full range of supervisory responsibilities for the Bureau. o Direct the Bureau’s strategic priorities and provide Executive level consult and guidance.o Direct the Bureau’s workflow, prioritizing and assigning work. o Evaluating staff’s work product and provide direction as needed. o Review and approve Bureau Staff’s time and attendance. • Advises the Director of Human Resources Management of major labor changes, and sets agency strategy to resolve matters collaboratively in partnership with agency management and union partners.• Proactively identifies potential labor management risks and develops mitigation plans to resolve issues before they expand into larger concerns.• Designs and delivers training programs for supervisors and managers to ensure discussions with employees are consistent with OPRHP standards and all applicable rules, policy and law. • Conduct the most difficult and sensitive hearings. • Direct and review investigations; manage the improvement and quality of investigations. • Review and update the statewide Labor Relations training module for Executive and Management level staff on Labor Relations policies and procedures. • Conduct statewide visits to evaluate labor relations programs and recommend appropriate actions as needed. • Review and evaluate changes in negotiated agreements and advise management on impacts of labor relations programs. • Participate in special projects as assigned by the Director of Labor Relations, Director of Human Resources, or Director of Personnel. • Liaison with GOER on a variety of topics. • Investigate and respond to allegations of Fraud, Waste & Abuse from OPRHP employees in concert with the OPRHP Director of Internal Audit.• Representing OPRHP management at various administrative hearings, including Improper Labor Practice Hearings, Section 72/73 hearings, as well as NYS Division of Human Rights proceedings. • Representing management at arbitration proceedings and at statewide and agency level negotiations. Review and evaluate changes in negotiated agreements. • Represent OPRHP management in the Labor/Management Committee Process, as well as meeting collaborating with union representatives on issues of mutual concern and joint initiatives. • Serve as management designee for the Statewide Employee Assistance Program (EAP).• Develop proposals for funding labor management projects from various work/life committees and assist in their implementation. Minimum Qualifications Promotion: Either A: One year of service as an Associate Director Human Resources 2 (Labor Relations) or two years of service as a Human Resources Specialist 3 (Labor Relations).You may also apply if you are eligible for appointment by reinstatement or one of the following qualifications:52.7 Non-Competitive Promotion (NCP) Qualifications:To be eligible for NCP, candidates must be in the NYS Office of Parks, Recreation and Historic Preservation promotion field and meet the promotion qualifications above. If 3 or fewer qualified NYS Office of Parks, Recreation and Historic Preservation eligible promotional employees respond to this posting, Civil Service may approve the permanent appointment of one of the qualified employees without further examination.Note: Non-competitive refers to not competing in an examination; the appointment will be competitive.Provisional Qualifications:In the absence of eligible lists with three or more candidates willing to accept a position, a temporary provisional appointment may be considered. For provisional appointment, candidates must meet the promotion qualifications above.The appointed candidate would have to take, pass and be reachable on the next holding of the examination to be appointed permanently.52.6 Transfer Qualifications:At least one year of permanent competitive or 55-b/c service as an M-2/Grade 27 or higher.
