Position Overview: Senior Counsel, Open Banking

Open Banking is rapidly evolving globally, poised to revolutionize various facets of financial services.

Mastercard has developed an initial range of Open Banking Solutions and has acquired Finicity, a prominent US-based open banking data aggregation and analytics firm, as well as Aiia in Europe, with the aim of expanding our global presence.

We are seeking a technology and transactional attorney to offer legal support and guidance for product development and commercial sales to our North American open banking division.


Key Responsibilities:
  • Conduct legal and business risk evaluations on issues related to new product frameworks, sales contracts, and market entry strategies concerning Mastercard's open banking offerings in North America.
  • Provide legal advice throughout the lifecycle of various solutions and services, from conception to launch and beyond.
  • Draft and negotiate agreements for technology sales, resellers, and vendors.
  • Oversee contractual negotiations with partners within the open banking ecosystem, including fintech companies, financial institutions, merchants, processors, and service providers.
  • Offer legal counsel on a broad spectrum of commercial and contractual issues.
  • Collaborate across product and legal teams (including data privacy, intellectual property, antitrust, regulatory compliance, and franchise) to ensure product frameworks and commercial agreements align with corporate strategy, internal policies, and applicable laws.
  • Engage with internal and external regulatory counsel regarding the implications of local laws and government regulations on Mastercard's North American open banking solutions.
  • Build strong relationships with product development, business, and sales teams, as well as senior management.
  • Ensure adherence to company policies and procedures.
  • Support initiatives of the open banking team in North America and globally; assist international colleagues as required.
  • Manage special projects while maintaining a steady flow of daily responsibilities.
Qualifications:
  • Strong transactional training and experience (in-house experience preferred).
  • Experience with product development and open banking or other regulated products is advantageous.
  • Excellent business acumen and communication skills to engage confidently and effectively.
  • Quick learner capable of rapidly understanding complex and evolving products and navigating intricate legal and regulatory challenges.
  • Detail-oriented with the ability to prioritize and manage multiple projects and demands.
  • Proficient drafting and negotiation skills across a variety of complex commercial contracts, with the ability to analyze and identify key legal issues.
  • Team-oriented, willing to take on diverse responsibilities that support the team, department, and organization.
  • Able to work independently and collaboratively, including with global colleagues, while also taking direction from managers and team members as needed.
  • Juris Doctor from an accredited law school; licensed to practice law in the US.
