About The Bail Project

Identifying the Issue

The criminal justice system often ties freedom to financial resources, leading to unjust outcomes for those unable to afford bail. This system disproportionately affects marginalized communities, contributing to mass incarceration and social inequities.

Our Approach

The Bail Project is a national nonprofit organization dedicated to providing complimentary bail assistance and pretrial support to low-income individuals. Our mission is to challenge mass incarceration and advocate for a fairer, more just pretrial system.

Operational Model

Utilizing a national revolving bail fund, The Bail Project pays bail for individuals presumed innocent and deemed eligible for release by a judge. We offer court reminders, transportation, and collaborate with local organizations to connect clients with essential social services. This model, termed Community Release with Support, has shown significant success in ensuring clients attend their court dates. As cases conclude, the bail funds are recycled to assist more individuals, ultimately aiming to eliminate cash bail through legislative and policy reforms.

Our Team

We are a dedicated group of advocates focused on dismantling mass incarceration and promoting racial and economic justice. Our structure includes a central support hub and a network of client advocates, known as "Bail Disruptors," who provide bail assistance and engage in advocacy efforts within their communities.

Role Overview

The Legal Counsel/Assistant General Counsel will be integral to the General Counsel's Office, providing legal representation and guidance for The Bail Project. This office manages all legal matters, ensuring compliance with applicable laws and organizational policies. The Legal Counsel/Assistant General Counsel will support the General Counsel in various essential functions, including:

  1. Drafting and reviewing contracts and agreements;
  2. Conducting legal research and advising on compliance with laws and regulations;
  3. Participating in the selection and management of external legal counsel;
  4. Coordinating litigation strategies with outside counsel;
  5. Ensuring corporate compliance across relevant jurisdictions;
  6. Providing legal insights on policy initiatives and legislative proposals;
  7. Advising on general legal matters, including data privacy, employment law, and intellectual property;
  8. Collaborating with the COO to develop staff-friendly compliance policies;
  9. Ensuring communications align with legal standards;
  10. Training staff on legal topics relevant to the organization;
  11. Addressing sensitive issues raised to the General Counsel's Office;
  12. Performing additional duties as required.

Qualifications:

  1. Juris Doctorate from an accredited U.S. law school;
  2. Active legal license in any U.S. state or territory;
  3. 1 to 5 years of relevant legal experience, including strong research skills;
  4. A minimum of three years of experience for the Assistant General Counsel role;
  5. Experience with nonprofit corporate and tax issues is advantageous;
  6. Meticulous attention to detail;
  7. Strong ethical standards;
  8. Experience in a law firm, corporate legal department, or nonprofit organization is preferred;
  9. Knowledge of federal and state laws applicable to 501(c)(3) organizations is a plus;
  10. Familiarity with contract management, data privacy, and employment law;
  11. Excellent communication skills, capable of conveying complex legal concepts to diverse audiences;
  12. Strategic thinker with problem-solving abilities;
  13. Ability to manage multiple priorities efficiently;
  14. Willingness to work collaboratively in a dynamic environment;
  15. Commitment to racial justice and equity;
  16. Alignment with the mission and values of The Bail Project.
