About The Bail Project
Identifying the Issue
The criminal justice system often ties freedom to financial means, with those unable to afford bail remaining incarcerated while wealthier individuals secure their release. This disparity undermines the presumption of innocence and exacerbates racial and economic inequalities, contributing significantly to mass incarceration.
Our Approach
The Bail Project is a national nonprofit organization dedicated to providing complimentary bail assistance and pretrial support to low-income individuals. Our mission is to challenge mass incarceration and advocate for a more just and equitable pretrial system.
Our Model
Utilizing a national revolving bail fund, The Bail Project pays bail for individuals who are presumed innocent and deemed eligible for release by a judge. We offer additional support, including court reminders and transportation, while collaborating with local organizations to connect clients with voluntary social services. This model, termed Community Release with Support, has proven effective in ensuring clients attend their court dates. As cases conclude, the bail is returned to the fund, allowing us to assist more individuals. Our ultimate goal is to end cash bail and promote legislative changes through the stories and data we gather.
Our Team
We are a dedicated group of advocates focused on dismantling mass incarceration and promoting racial and economic justice. Our organization comprises a central support hub and a network of client advocates, known as "Bail Disruptors," who work within their communities to provide bail assistance and drive advocacy efforts.
Role Overview
The Legal Counsel/Assistant General Counsel will be integral to the General Counsel's Office, supporting the organization in various legal matters. This office is responsible for advising The Bail Project and managing all legal affairs, either directly or through oversight of external legal counsel. The role is crucial in ensuring that the organization's strategies and policies are developed with a comprehensive understanding of legal implications and risks.
Key Responsibilities:
- Draft and review various contracts and agreements;
- Conduct legal research and provide advice to ensure compliance with relevant laws and regulations;
- Assist in the hiring and management of external legal counsel;
- Collaborate with outside counsel to develop litigation strategies;
- Support corporate compliance and registration across jurisdictions;
- Advise on proposed policy initiatives and review relevant legislation;
- Coordinate with outside counsel on general legal matters, including data privacy and employment law;
- Work with the COO to create policies and procedures for legal compliance;
- Ensure communication strategies align with applicable laws, particularly regarding data privacy;
- Provide training to staff on legal topics;
- Address sensitive issues directed to the General Counsel's Office;
- Perform additional duties as assigned.
Qualifications:
- Juris Doctorate from an accredited law school;
- Active legal license in any U.S. state or territory;
- 1 to 5 years of relevant legal experience, including legal research and analysis;
- A minimum of three years of experience is required for the Assistant General Counsel role;
- Experience with nonprofit corporate and tax matters is advantageous;
- Meticulous attention to detail;
- Strong ethical standards;
- Preferred experience in a major law firm, in-house at a corporation, or a nonprofit;
- Familiarity with federal and state laws applicable to 501(c)(3) organizations is a plus;
- Knowledge in contract management, data privacy, and employment law is desirable;
- Exceptional communication skills, both written and oral;
- Strategic thinker with problem-solving abilities;
- Ability to manage multiple tasks and meet deadlines;
- Willingness to work collaboratively in a dynamic environment;
- Commitment to racial justice and equity;
