Position Overview

As a member of the Employment Law Section (ELS) within the California Department of Justice, you will engage in legal challenges related to various employment laws, including the Fair Employment and Housing Act, Title VII, Americans with Disabilities Act, Family and Medical Leave Act, California Family Rights Act, and the Whistleblower Protection Act, among others.
Key Responsibilities:
- Independently manage all facets of intricate civil employment litigation, which includes drafting and presenting motions, interviewing witnesses, conducting and defending depositions, and preparing for trial.
- Oversee jury and bench trials.
- Conduct contested administrative evidentiary hearings before the State Personnel Board.
- Defend agency administrative actions against petitions for writs of mandamus.
- Draft appellate briefs and present arguments before the Courts of Appeal and Ninth Circuit.
- Secure work safety and gun violence restraining orders.
- Engage with clients, providing comprehensive case analyses and strategic recommendations.
- Offer training, guidance, and legal advice to state agencies on various employment and personnel issues.
- Communicate effectively with judges, court personnel, juries, and witnesses.
- Collaborate professionally and efficiently with colleagues, opposing counsel, and clients.
All candidates must be residents of California and active members in good standing of the California State Bar.
Work Environment:
ELS deputies have the flexibility to choose between teleworking or working in the office, depending on their preference. As a litigation section, there may be occasions requiring in-office attendance for meetings, court appearances, or other operational necessities. However, deputies are encouraged to telework when possible, provided they can report to the office in case of urgent needs and remain accessible during standard business hours.
Additional Requirements:
- A fingerprint background check will be mandatory.
- Active membership in the California State Bar is required.
