About The Bail Project
Issue Overview
The criminal justice system often ties liberty to financial means, where individuals unable to pay bail remain incarcerated pre-trial, while those with resources secure their freedom. This disparity undermines the principle of innocence until proven guilty and exacerbates racial and economic inequalities, contributing significantly to mass incarceration. Millions are held in jails annually due to their inability to afford bail.
Our Approach
The Bail Project is a national nonprofit organization dedicated to providing complimentary bail assistance and pretrial support to low-income individuals. Our mission is to challenge mass incarceration and advocate for a more just, equitable, and effective pretrial system.
Operational Model
Utilizing a national revolving bail fund, The Bail Project pays bail for individuals presumed innocent and approved for release by a judge. We also offer court reminders, transportation, and collaborate with local partners to connect clients with voluntary social services and community programs. This model, termed Community Release with Support, has demonstrated significant success in ensuring court attendance.
Our Team
We are a collective of advocates focused on dismantling mass incarceration and promoting racial and economic justice. Our organization comprises a central support hub and a network of client advocates, known as "Bail Disruptors," who provide bail assistance and drive advocacy efforts in their communities.
Role Overview
The Legal Counsel/Assistant General Counsel will join the General Counsel's Office, providing legal representation and guidance to The Bail Project. This role is crucial in supporting the General Counsel's functions, including the following responsibilities:
Key Responsibilities:
- Draft and review various contracts and agreements;
- Conduct legal research and advise the organization on compliance with applicable laws and regulations;
- Assist in the recruitment and management of external legal counsel;
- Collaborate with external counsel to formulate litigation strategies;
- Ensure corporate compliance and registration across relevant jurisdictions;
- Advise on proposed policy initiatives;
- Coordinate with external counsel on general legal matters;
- Develop staff-friendly policies and procedures in partnership with the COO;
- Work with various teams to ensure compliance with communication strategies;
- Provide training for staff on legal topics;
- Address inquiries and concerns directed to the General Counsel's Office;
- Perform additional duties as assigned.
Qualifications:
- Juris Doctorate from an accredited U.S. law school (required);
- Active legal license in any U.S. state or territory (required);
- 1 to 5 years of relevant legal experience (required);
- A minimum of three years of relevant experience for the Assistant General Counsel position;
- Experience with nonprofit corporate and tax matters is advantageous;
- Strong attention to detail and ethical standards;
- Preferred experience at a major law firm, in-house at a large corporation, or in a nonprofit setting;
- Familiarity with federal and state laws applicable to 501(c)(3) organizations is preferred;
- Exceptional written and verbal communication skills;
- Strategic thinker with foresight to anticipate challenges;
- Ability to meet tight deadlines and manage multiple tasks efficiently;
- Willingness to work collaboratively in a team-oriented environment;
- Commitment to racial justice and equity in all work;
- Demonstrated alignment with the mission and values of The Bail Project.

This position is fully remote. The Bail Project will provide necessary equipment for remote work, but candidates must have reliable internet access.
Compensation and Benefits:
This is a full-time, exempt position.
