Job Title: Trademark Attorney - Brand Protection Expert
About the Role:
We are seeking a talented Trademark Attorney with patent prosecution experience to join our team at Direct Counsel, LLC. This is an excellent opportunity for an associate to advance their career by managing trademark prosecution and enforcement matters while working with a dynamic team.
About the Intellectual Property – Patent and Trademark Prosecution Section:
This practice provides comprehensive strategic counseling in patent and trademark law, enabling clients to achieve their business goals throughout the innovation lifecycle. The team advises clients on clearing, prosecuting, and managing trademark rights, enforcing their brand rights, and licensing brand portfolios. Additionally, they help clients navigate the complexities of trademark protection in various industries.
Responsibilities:
- Conduct U.S. and global trademark clearance searches to identify potential risks and opportunities for clients.
- Draft identification of goods/services, evaluate specimens, and prepare office action responses for the USPTO to ensure seamless prosecution of trademarks.
- Counsel clients on Madrid Protocol filings to expand their international trademark portfolio.
- Handle enforcement investigations, draft cease and desist letters, and negotiate trademark settlement and coexistence agreements to protect clients' brand interests.
- Draft trademark, copyright, and NIL licenses and assignments to facilitate commercial transactions.
- Provide counsel on domain name enforcement, including drafting UDRP complaints to resolve domain name disputes.
- Review and clear content for use on social media and in digital marketing to minimize brand risk.
- Offer diligence and corporate transaction support on trademark, copyright, and domain matters to ensure a smooth transaction process.
Requirements:
- Juris Doctor (JD) or Master of Laws (LLM) from an American Bar Association (ABA)-accredited law school.
- Admission to or eligibility for admission in California or New York.
- 2+ years of trademark experience focused on clearance, prosecution, and enforcement.
- Strong legal research, writing, and analytical skills to provide high-quality work product.
- Excellent written and oral communication skills to effectively collaborate with clients and colleagues.
- Ability to prioritize tasks, meet deadlines, and balance competing responsibilities in a fast-paced environment.
- Strong organizational skills and attention to detail to maintain accuracy and precision in work.
- Ability to collaborate effectively in team settings to drive results and achieve shared goals.
Compensation:
The estimated salary range for this position is $235,000 to $310,000, with bonus eligibility based on individual performance and company achievements. We offer a comprehensive benefits package to support your physical and mental well-being.
