Job Summary

We are seeking a highly skilled Pre-Litigation Team Lead to join our team at The Dominguez Firm, LLP. As a key member of our litigation support team, you will be responsible for overseeing and managing a team of case managers, conducting regular file reviews, and assisting with the medical management of pre-litigation matters.

Key Responsibilities
  • Oversee and manage a team of case managers, providing guidance and support as needed.
  • Conduct regular file reviews with the Supervising Attorney to ensure compliance with firm policies and procedures.
  • Assist case managers with the day-to-day management of medical treatment for pre-litigation matters, including reviewing medical reports and medical recommendations.
  • Assist case managers with negotiating pre-litigation settlements, ensuring that all parties are fairly represented.
  • Conduct monthly file reviews with each team member to ensure that all cases are being managed effectively.
  • Review and edit demands written by the demand team to ensure accuracy and completeness.
  • Responsible for the medical management of all assigned PI matters, including reviewing all medical reports and medical recommendations by treating medical providers.
  • Keep a close eye on the medical management of commercial cases, avoiding sub-outs whenever possible.
  • Be available to assigned case managers for guidance, supervision, and assistance.
  • Complete intro calls for new clients within one week of case assignment.
  • Review every new case coming to your pod, issue-spot, and write early To-Dos for case managers, including ruling in or out government entities, statute of limitations, loss of consortium, NIED, loss of consciousness, Glasgow scale, MRIs, radiculopathy, severity of biomechanics, and reaching out to additional injured parties in the same accident.
  • Assist case managers with any client problems or potential problems.
  • Assist Medical Records Coordinators and Medical Liens Negotiators as needed.
  • Make an informed decision about when a file is ready for demand, considering factors such as broken bones, discharge paperwork, third-party 15/30, residuals, and additional medical work-up needed.
  • If a third party fails to tender policy limits within the time frame provided, communicate with the Managing Attorney and review for open policy considerations.
  • Settle cases in your pod with adjustors and clients.
  • Obtain releases from insurance companies and review them to ensure that we are releasing the correct parties, not waiving UIM, nor restitution where applicable, and if PD is outstanding, that the release does not include PD claims.
  • On a policy limits tender case, obtain a Declaration of No Additional Insurance (DNAI) and dec page from the tendering third-party insurance company, along with an asset search against any responsible third party(ies).
  • Review breakdowns and medical rosters for accuracy.
  • Obtain signatures from clients on breakdowns and releases, using case managers to assist as needed.
  • Assist Intakes Dept. with Under Reviews, when available.
