POSITION SUMMARY: The Construction Law Specialist will oversee and manage all facets of legal matters related to construction, including litigation and dispute resolution. This role demands a comprehensive understanding of construction law, contract negotiation, and risk assessment. The successful candidate will collaborate closely with project teams, subcontractors, and external legal advisors to mitigate legal risks and ensure adherence to industry standards. By refining and enhancing legal processes, this individual will play a vital role in the growth and development of The Bowa Group Inc.

KEY RESPONSIBILITIES:

  • Litigation Oversight: Manage all stages of construction-related litigation, encompassing pre-litigation advice, discovery, motions, trial preparation, and settlement discussions.
  • Contractual Analysis and Negotiation: Evaluate, draft, and negotiate construction contracts, subcontracts, and related agreements to ensure legal compliance and safeguard the company's interests.
  • Risk Assessment: Identify potential legal challenges and offer strategic guidance to project teams to mitigate those risks. Develop and implement risk management protocols.
  • Dispute Management: Address disputes arising from construction projects, including delays, defects, payment disputes, and contract breaches. Strive to resolve conflicts through negotiation, mediation, arbitration, or litigation as necessary.
  • Compliance Assurance: Ensure adherence to federal, state, and local regulations, as well as industry standards. Stay informed about changes in construction law and advise on their implications.
  • Collaborative Support: Work in tandem with project managers, engineers, and other stakeholders to provide legal support and facilitate successful project outcomes. Coordinate with external legal counsel as required.
  • Documentation Management: Maintain comprehensive records of all legal proceedings, contracts, and correspondence related to construction projects. Prepare and submit reports to senior management and the General Counsel.
  • Training and Guidance: Provide training to project teams on legal matters, contract management, and risk mitigation strategies.

QUALIFICATIONS:

  • Juris Doctor (JD) degree from an accredited law institution.
  • Licensed to practice law and in good standing with the state bar.
  • 2-5 years of experience in construction law.
  • Strong knowledge of construction law, contract law, and regulatory compliance.
  • Excellent negotiation, communication, and interpersonal skills.
  • Ability to manage multiple cases and projects concurrently.
  • Detail-oriented with strong analytical and problem-solving capabilities.
  • Ability to work independently and collaboratively.
  • Proficient in legal research and writing.
