Position Overview:
The Assistant County Attorney serves as a vital full-time role, appointed by the Allegany County Attorney, to support the Chief Legal Counsel for the Allegany County Board of Legislators and its various County Departments. It is essential for the selected candidate to be a permanent resident of Allegany County at the time of appointment and to maintain residency throughout their employment, in accordance with New York State Public Officers Law.
Key Responsibilities:
- Acting on behalf of the County Attorney in Juvenile Delinquent and Persons in Need of Supervision (PINS) cases.
- Drafting and reviewing contracts, resolutions, notices, pleadings, appeals, and other legal documents under the guidance of the County Attorney.
- Managing the prosecution and defense of civil actions as directed by the County Attorney.
- Providing assistance in representing the Department of Social Services in Family Court matters, including Child and Spousal Support, Child Abuse and Neglect, Custody and Visitation, Termination of Parental Rights, and Permanency Hearings for children in foster care, when necessary.
- Conducting legal research and providing legal advice, opinions, and analysis to the Board of Legislators or any County Department in the absence of the County Attorney or as directed.
Qualifications:
The ideal candidate should possess a comprehensive understanding of county law and relevant New York State laws that influence county operations. They must demonstrate the ability to articulate legal arguments clearly in both written and verbal forms, while upholding ethical standards in legal practice.
Minimum Requirements:
Applicants must be graduates of an accredited law school and hold admission to the New York State Bar at the time of appointment.
Special Considerations:
The incumbent is required to be a permanent resident of Allegany County at the time of appointment and to maintain residency throughout their employment as mandated by the Public Officers Law.
