Job Summary

Flynn Group, a leading franchise operator, seeks an exceptional Employment Counsel to join its industry-recognized legal team. In this position, you will play a critical role in litigating, counseling, and supporting compliance efforts for the company's vast network of restaurants and gyms across the U.S. and Australia.

Key Responsibilities
  • Litigation and Arbitration
    • Support the handling of litigation and arbitration matters from start to finish, including interviewing witnesses, preparing for and taking depositions, handling written discovery and motion practice, and participating in arbitration and/or trial.
  • Employment Law Counseling
    • Provide advice and counseling across a broad spectrum of employment issues, including wage and hour, payroll, benefits, hiring, performance management, internal investigations, leaves of absence, discipline, terminations, employee classification, and employee privacy.
  • Compliance and Risk Management
    • Collaborate with Legal, HR, Payroll, Operations, Risk, and Training on employment-related compliance matters, including conducting wage and hour compliance audits, identifying additional areas of employment-related compliance opportunities, advising on preventative and corrective action plans, and supporting training initiatives.
  • Policy Development and Updates
    • Support updating and revising company policies per changes in external laws and regulations.
  • Legislative Monitoring and Updates
    • Monitor federal, state, and local legislation, regulations, and case law on employment-related matters pertinent to the company; communicate updates and recommendations as needed.
Requirements
  • 4-6 years of employment law experience.
  • Juris Doctor from an accredited law school; must have California Bar admission in good standing.
  • Experience in various stages of employment litigation, as well as knowledge of federal and state employment laws and regulations (e.g., Title VII, ADA, FMLA, FLSA, FEHA, PAGA) and federal and state agencies (e.g., DOL, EEOC, DLSE, DFEH). Privacy counseling and advice experience a plus.
  • Experience with single plaintiff litigation matters. Experience with class/representative/collective actions a plus.
  • Entrepreneurial mindset that enables you to work independently, while using good judgment to escalate issues when needed.
  • Demonstrated ability to guide multiple objectives and initiatives simultaneously.
