Job Summary:
We are seeking a highly skilled Litigation Representative to join our team at Michigan Farm Bureau. The successful candidate will be responsible for investigating, evaluating, and supervising first-party casualty claims in litigation.
Key Responsibilities:
- Develop and maintain in-depth knowledge of Michigan law, including the No-Fault Automobile Act, negligence, products, and insurance contract law.
- Review and advise on changes in statutory law, case law, and legal practice affecting claim handling and litigation management.
- Participate in meetings and collaborative efforts, providing constructive feedback and advice on claim handling.
- Encourage best practices in claim handling by maintaining accurate and timely records, providing guidance to file handlers, and ensuring compliance with company policies.
- Monitor the performance of retained counsel and provide advice on attorney selection.
- Support the development and implementation of strategies to reduce legal expenses.
- Investigate claims in a timely and equitable manner, managing litigation as assigned.
- Maintain regular contact with insureds, providing updates on claim status.
- Evaluate and advise the Underwriting Department on questionable risks.
- Review medical bills for proper payment.
- Develop and maintain a personal training program to enhance job skills and career development.
- Work with computer systems to perform key functions, including letter composition, log entry, and report drafting.
- Resolve concerns and complaints related to claim settlement procedures and actions in a timely manner.
- Develop professional relationships with attorneys, physicians, and claims professionals.
- Participate in court appearances, including depositions and trials.
- Assist adjusters in developing a litigation plan and identifying strategic points for resolution.
- Foster an attitude of early, realistic, and candid analysis of liability and damages.
- Foster a willingness to adapt to changing legal, technical, and managerial environments.
Qualifications:
- Bachelor's degree, CPCU, or equivalent experience required.
- Basic insurance course and medical interpretation courses required.
- Minimum five years of experience with litigated claims required.
- Extensive knowledge of claims procedures and practices, as well as no-fault coverage.
- Knowledge of tort, workers' compensation, and contract law, as well as medical terminology, anatomy, and rehabilitation.
- Extensive knowledge of insurance contracts written by the company and ability to interpret insurance contracts.
- Valid driver's license with an acceptable driving record required.
Preferred Qualifications:
- Knowledge and experience handling Michigan Assigned Claim Plan (MACP) claims.
- Knowledge and experience with Michigan Catastrophic Claims Association (MCCA) reporting and practices.
- Background in handling SIU claims and functions, or willingness to learn.
- Designations in AIC, AINS, SCLA, or other insurance-related designations.
