About The Bail Project

The Challenge

The intersection of financial capability and justice is starkly evident in the bail system. Individuals unable to afford bail remain incarcerated pre-trial, while those with financial means secure their freedom. This disparity undermines the presumption of innocence, disrupts lives, and exacerbates racial and economic inequalities, contributing significantly to mass incarceration. Annually, approximately 2.5 million individuals are detained in jails across the United States due to their inability to pay bail.

Our Approach

The Bail Project is a national nonprofit organization dedicated to providing complimentary bail assistance and pretrial support to thousands of economically disadvantaged individuals each year. Our mission is to challenge mass incarceration and illustrate that a more humane, equitable, and effective pretrial system is achievable.

Our Model

Utilizing a national revolving bail fund, The Bail Project pays bail for individuals who are legally presumed innocent and deemed eligible for release by a judge. We also offer court reminders, transportation, and collaborate with local partner organizations to connect clients with voluntary social services and community-based programs. This model, termed Community Release with Support, has proven highly effective in ensuring clients attend their court dates.

Our Team

We are a collective of advocates committed to dismantling mass incarceration and promoting racial and economic justice. Our organization comprises a central support hub and a network of client advocates, referred to as "Bail Disruptors," who operate within their local communities to provide bail assistance and advance advocacy efforts.

Role Overview

The Legal Counsel/Assistant General Counsel will be integral to the General Counsel's Office, reporting directly to the General Counsel. This office represents and advises The Bail Project, safeguarding management interests by recommending or taking discretionary actions that effectively implement organizational policies. The Legal Counsel/Assistant General Counsel plays a crucial role in supporting the General Counsel in fulfilling key responsibilities, including but not limited to the following:

Key Responsibilities:

  1. Draft and review various contracts and agreements;
  2. Conduct legal research and provide advice to ensure compliance with applicable laws and regulations;
  3. Engage in the hiring process and manage relationships with external legal counsel;
  4. Coordinate with outside counsel and develop litigation strategies under the General Counsel's supervision;
  5. Assist with corporate governance, registration, and compliance across relevant jurisdictions;
  6. Advise on proposed policy initiatives;
  7. Provide legal guidance across various areas of general law;
  8. Collaborate with the COO to develop staff-friendly policies and procedures for legal compliance;
  9. Work with Communications, Marketing, and Development Teams to ensure compliance with federal and state laws in communication strategies;
  10. Facilitate or oversee training for staff on topics relevant to the General Counsel's Office;
  11. Research and address issues raised to the General Counsel's Office;
  12. Perform additional duties as assigned.

Qualifications:

  1. Juris Doctorate from an accredited U.S. law school (required);
  2. Active legal license in any U.S. state or territory (required);
  3. 1 to 5 years of relevant legal experience (required);
  4. A minimum of three years of relevant experience is necessary for the Assistant General Counsel role;
  5. Experience with nonprofit corporate and tax matters is advantageous;
  6. Strong attention to detail;
  7. High ethical standards;
  8. Preferred experience at a major law firm, in-house at a large corporation, or within a nonprofit organization;
  9. Familiarity with federal and state laws applicable to 501(c)(3) organizations is preferred;
  10. Exceptional written and verbal communication skills;
  11. Strategic thinker with the ability to foresee challenges;
  12. Ability to meet tight deadlines and manage multiple tasks efficiently;
  13. Willingness to work collaboratively in a team-oriented environment;
  14. Commitment to addressing issues through a racial justice and equity lens;
  15. Demonstrated dedication to the mission and values of The Bail Project.

This position is fully remote. The Bail Project will provide necessary equipment for remote work, but candidates must have reliable internet access.

Compensation and Benefits:

This is a full-time, exempt position.
