Serves as the principal institutional official responsible for developing, coordinating, implementing and overseeing institutional compliance programs, including compliance with Title IX of the Education Amendments of 1972 (Title IX), the Violence Against Women Reauthorization Act (VAWA), Americans with Disabilities Act/Section 504 of the Rehabilitation Act of 1973, non-discrimination laws and other applicable federal, state and local laws and regulations.

The Director of Compliance/Title IX Coordinator is a management position residing in the President Office.

The Director of Compliance/Title IX Coordinator is responsible for carrying out, monitoring and oversight of the Title IX grievance process at the College, including coordination of training, education, communications, and the administration of complaint procedures and educating the entire college community about the protections provided for a welcoming and inclusive campus.

Develops, oversees and maintains processes for addressing Title IX, discrimination and civil rights complaints/reports of discrimination, harassment or sexual violence and related allegations of misconduct.

Keeps affected parties apprised of the existence and status of complaints.

Ensures investigations of reports/complaints of sexual discrimination and/or misconduct are adequate, reliable, timely, confidential and impartial.

Manages cases in compliance with Title IX, Anti-Discrimination, VAWA and Clery policy and requirements. Monitors and investigates college programs and scholarship offerings to ensure compliance with Title IX and other anti-discrimination statutes, rules and regulations. Coordinates and/or conducts investigations in response to alleged civil rights violations, including illegal discrimination, harassment and sexual misconduct under Title VI, Title VII and Title IX filed by college students, staff, faculty and/or visitors in compliance with federal and state laws, executive orders, regulations and college policies and procedures. Works with investigators on proposed sanctions for discriminatory harassment and misconduct to ensure they are reasonably calculated to stop the misconduct and prevent its recurrence. Works collaboratively with Student Services, General Counsel and the college’s Deputy Title IX Coordinators to ensure informed and consistent communication in policy implementation. Provides and/or facilitates educational and training programs regarding Title IX, discrimination and sexual harassment prevention to staff and students Coordinate and collaborate with General Counsel to draft policy updates to the Title IX Policy based on federal guidance and regulations. Assists in the formulation, review and revision of written policies, procedures, and guidelines related to civil rights and compliance obligations and complaint procedures. Monitors, audits and oversees compliance of college policies and procedures, including assigned federal and state laws, regulations and compliance obligations.

Provides documentations of these efforts, including but not limited to: Title IX, VAWA, Clery Act, ADA, Title VII of the Civil Rights Act of 1964. Monitors and remains current on applicable laws, regulations or orders, including responsibilities for understanding and implementing the most current Title IX regulations. Research projects assigned by college leadership, including General Counsel and the Vice President Human Resources. Provide remedies, guidance and training to alleviate and prevent allegations involving prohibited conduct as defined in the Title IX Policy.

Coordinate the College’s response to such allegations in collaboration with College Police

Coordinate and assist in protections associated with pregnancy, childbirth, false pregnancy, termination of pregnancy, or recovery from any of these conditions, including lactation needs, covered until Title IX and Title VII.

Participate in ongoing training specific to Title IX to stay current on gender-based discrimination cases including implicit bias training, investigation training, coordinator training, and/or other training stipulated by federal regulations to stay informed about Title IX requirements

Monitor and stay current on federal guidance associated with Title IX, including participation in various listservs related to Title IX.

Works with faculty and staff to clarify the College’s responsibilities under all federal civil rights protections (e.g., Title IX and Section 508/504/ADA, etc.)

Provide oversight and direction to the Deputy Title IX Coordinators, Title IX Advisors, Title IX Hearing Officers/Decision Makers, and the Title IX Appellate Officers, including adherence to federal training requirements for all parties as it relates to Title IX training.

Refer individuals to the Campus Community Care Team (C3T) as necessary.

Coordinate the information requirements for the College’s Title IX website and print-based publications with the appropriate college departments to ensure information about policy, process, and resources for applicants, employees, students, third parties, witnesses, reporting/responding parties is available and properly displayed per federal regulations.

Persons in this role are identified as Campus Security Authority (CSA). CSA's will be trained and responsible for reporting Clery Reportable Crimes to Campus Police as required by the Clery Act.

Remains current on all Equal Employment Opportunity (EEO) laws and regulations to provide consultation on administrative decisions impacting Macomb Community College’s EEO and Title IX compliance obligations as necessary.

Assist with EEO investigations as a result of discrimination and harassment complaints filed by member of the College community.

Evaluates documentation provided and advises individuals and departments on appropriate action(s) to be taken in conjunction with the General Counsel. Provides and/or coordinates mediation or restorative practices, as needed.

Required - The successful candidate must possess a related Master’s degree or higher with at least three years of experience in Title IX and compliance in relations to the requirements of the job description.

Required experience includes five (5) years working with compliance and assistive technologies and five (5) or more years of experience in a high-level compliance function, including experience conducting internal investigations.

Required experience includes five (5) years’ experience in Title IX in either a Title IX Coordinator or Title IX Deputy Coordinator role.
