Job Duties:
  • The Senior Associate provides legal advice to Insight and its affiliates on regulatory and corporate matters and performs a variety of other legal duties including, but not limited to, legal review of transactions, arrangements, and agreements on behalf of Insight and its affiliated entities; and supporting the General Counsel on various special projects
  • Serves as primary legal liaison for operation of Insight Michigan and its affiliated entities,
  • Serves as primary legal liaison on committees and assists in the formulation and implementation of policies and practices regarding regulatory and compliance related matters
  • Provides oversight of the review, vetting and development of internal regulatory and compliance policies and procedures, ensuring compliance with all relevant laws
  • Assist General Counsel on regulatory matters, including billing issues
  • Develop, draft, and negotiate of joint ventures, affiliations, networks, legal entities, and other transactional initiatives, including interfacing and managing outside transactional legal counsel in Michigan under the purview of General Counsel
  • Provides oversight and legal advice to Insight, senior leaders, and all Insight affiliated entities on regulatory issues relating to healthcare, including, but not limited to, Medicare and Medicaid program reimbursement and coverage matters (including Medicare Advantage and Medicare Part D), fraud and abuse laws and regulations (including the Anti-Kickback and Stark Laws), HIPAA and other data privacy laws, the Affordable Care Act, laws relating to tax-exempt organizations, Joint Commission standards, ACHC standards, compliance program implementation and oversight, and state licensing and regulatory matters
  • Provides development guidance in the identification, implementation, and maintenance of Insight and its affiliated entities patient health information privacy and security policies and procedures in coordination with management and administration, corporate compliance, and legal counsel for RUMC and its affiliated entities
  • Assure legal and regulatory compliance in various Insight contracts and transactional matters at the direction of General Counsel
  • Coordinate Corporate Compliance program under direction of General Counsel
  • Provide legal review and approval of agreements on behalf of Insight, including, but not limited to: Physician Contracts, Business Associate Agreements, Data Registry and Collaborative Research
  • Negotiate legal terms on behalf of Insight directly with contracting parties to resolve legal issues to the satisfaction of both parties
  • Oversee and assist General Counsel with regulatory legal review and approval of agreements on behalf of Insight and its affiliated entities, including but not limited to, Outsourcing Agreements, Business Associate Agreements, Collection Agency Agreements, Miscellaneous Service Agreements, Graduate Medical Education, Independent Contractors, Continuing Medical Education, Philanthropy Grants
  • Draft contract templates for use by various Insight departments to increase the efficiency of contract negotiation
  • Lead and provide regulatory support for internal investigations
  • Undertake other matters as assigned by the General Counsel

Qualifications:
  • Juris Doctor from an ABA accredited College of Law
  • Licensed to practice law in at least one state and in good standing in all states where admitted
  • Member of the Michigan State bar or eligible to sit for the Michigan State bar
  • The successful candidate will have superior academic credentials, and excellent, writing, analytical and oral communication skills
  • Experience should include healthcare M&A, contracting, research, regulatory matters and healthcare compliance
  • Knowledge of key regulatory areas applicable to hospitals and health care systems
  • Knowledge of Anti-Kickback Statute, Stark Law, and HIPAA (as well as applicable state laws) is essential
  • Must be highly organized and able to identify and analyze complex issues and develop creative solutions
  • Position requires a highly developed degree of business judgment, initiative, and ability to work independently and as part of a team
