Accountable for review and approval of product labeling and advertising content with support from General Counsel. Knowledge of local, state, and federal regulations with emphasis of FDA and FTC regulations. Act as a liaison between Legal and Business teams and provides technical support. KEY RESPONSIBILITIES: Product Compliance Interpret policies, procedures, guidelines, and legal and regulatory statutes regarding safety and compliance inquiries and issues. Assess conformity to FDA and FTC requirements for cosmetics, OTC drugs, medical devices, dietary supplements, and food products. Review performance of third-party testing and laboratory analysis including claims substantiation, efficacy testing, safety testing, Safety Data Sheets, and cGMP compliance. Collaborate with Samples, Merchandising, and Item Management teams to ensure all required product-specific assets are reviewed in a timely manner and are set up accurately. Collaborate with Merchandising, Producers, and Content Creators for On Air presentations. Content includes, but not limited to: Animations/Graphics Host Notes and Claims Summaries (Can and/or Can’t Say Sheets) Full Pages – On-Air slides Value Pages/Price Comparisons Befores and Afters Testimonials and Customer Reviews Collaborate with warehouse personnel to ensure goods are properly stored, labeled, and shipped per UPS, USPS, and US DOT requirements. Standards & Practices Interpret policies, procedures, guidelines, and legal and regulatory statutes regarding safety and compliance inquiries and issues. Perform regular proactive QA audits of shows on a test basis, and reports results. Draft written and verbal QA policy/process communications for Business teams. Manage issues regarding product claims and their substantiation and troubleshoot other advertising issues. Assist General Counsel and Outside Counsel on product and advertisement compliance concerns. Collaborate with General Counsel to identify potential issues and develop proactive solutions to eliminate or mitigate risks. Review miscellaneous Legal Compliance requests for other product categories in addition to Health, Beauty, and Food (i.e., Home, Consumer Electronics, Apparel, and Jewelry). Maintain FDA Food Facility Registration. Refine and implement detailed, technical quality guidelines and evaluation processes for Health, Beauty, and Food. Cross-functional Team Support Support vendor onboarding documents in collaboration with Legal and Merchandising. Provide regulatory guidance and answer compliance-related questions to cross-functional teams. Provide compliance support for state cause marketing, and FTC/state sweepstakes, contest, and price promotions and other social promotion compliance. Assist Item Management Specialists with web description reviews for Extended Assortment. Maintain partnerships with vendors to ensure compliance needs are met in a timely manner. Investigate root causes of excessive customer returns, negative customer contacts, negative web product reviews, and QC problems. Develop and implement corrective action plans. Value-added Activities Perform administrative tasks for Legal Compliance (e.g., Filing documentations, record keeping during team meetings). Educate cross-functional teams on the Standards of Operating Procedures. Continuous professional development to provide thorough compliance-related guidance. QUALIFICATIONS / KNOWLEDGE, SKILLS & ABILITIES: Bachelor’s degree or equivalent experience in a related subject matter area. 3-5 years of relevant work experience preferred. 1-2 years of supervisory experience preferred. Ability to define problems, collect data, establish facts, and draw valid conclusions. Effective written and verbal communication skills. Ability to understand technical scientific studies and laboratory analyses. Working knowledge of FTC and FDA laws and regulations as well as all known Federal, state, and local regulations for assigned categories. Ability to manage processes. Self-motivated, timely, reliable, and responsive to time urgent matters. Decision-making, organization, and planning skills. Working knowledge of Microsoft Office Suite. In order to ensure service levels, it is essential that the individual in this role be able to work a regular and reliable schedule as provided by management. Given the significant responsibilities of this role, it is essential that this role be filled on a full-time basis only.
