This position will provide legal assistance and will be responsible for providing legal counsel and advice to FPI and the Medical Service Plan (MSP) participating entities (i.e., physician practice groups (each a “PA ‘, collectively, the “PAs”) affiliated with FPI). ESSENTIAL FUNCTIONS 1. Contract work, including, but not limited to reviewing, drafting, negotiating: Professional Service Agreements; Management Service Agreements; Space Leases; Leasing Agreements for Physician Assistants and CRNPs; Leases Agreements for staffing, file storage, equipment; VA Contracts; HIPAA Business Associate Agreements; Clinical Research Agreements; Promissory Notes; Payor Agreements; etc. 2. Provides advice/support regarding – Federal and State Fraud and Abuse Laws (e.g., Stark, Anti‑Kickback) HIPAA and HITECH laws and regulations Subpoenas/Authorizations for Medical Records Patient Issues ("dismissals" of patients; disputes over records) New laws/regulations that affect the PAs/FPI Board of Physician Complaints Business Ventures; and Corporate minute books. 3. Investigates HIPAA and HITECH risks, inquiries and complaints; attend related meetings and support related FPI and PA initiatives. 4. Performs regulatory work, including researching and interpreting federal and state laws, regulations, interpretive guidelines and court cases for corporate and health care issues. 5. Develops reviews and/or revises corporate policies and procedures. 6. Reviews inquiries/complaints from state and federal administrative, regulatory and other governmental or accreditation agencies, perform necessary research of the law and internal practices, coordinate, draft, and prepare the response and/or reviewing responses to the government agency. Note: The intent of this list of primary duties is to provide a representative summary of the major duties and responsibilities of this job. The Associate Counsel shall perform other related duties as assigned. Specific duties and responsibilities may be modified based upon departmental needs. EDUCATION and/or EXPERIENCE Juris Doctor degree from an ABA accredited law school. Health Law Certificate from the University of Maryland School of Law or a similarly situated program preferred Admission to the Maryland Bar A minimum of five years of progressively responsible experience as practicing attorney Health care, corporate and privacy experience is preferred Total Rewards The referenced base salary range represents the low and high end of University of Maryland’s Faculty Physician’s Inc. salary range for this position. Some candidates will not be eligible for the upper end of the salary range. Exact salary will ultimately depend on multiple factors, which may include the successful candidate's geographic location, skills, work experience, market conditions, internal equity, responsibility factor and span of control, education/training and other qualifications.
