Role and Responsibilities:

Legal Research and Analysis:

  • Conduct thorough legal research on medical malpractice cases, staying abreast of relevant laws, precedents, and regulations. Provide insightful analysis to support the development of effective defense strategies.


Case Management:

  • Assist in managing a caseload of medical malpractice defense matters, including drafting pleadings, motions, and discovery documents. Ensure timely and accurate filing of court documents and adherence to procedural deadlines.


Client Communication:

  • Maintain clear and consistent communication with clients, keeping them informed of case developments, legal strategies, and potential outcomes. Respond promptly to client inquiries and collaborate with senior attorneys to address client concerns.


Deposition Preparation:

  • Prepare healthcare professionals and expert witnesses for depositions by conducting mock sessions, reviewing case details, and ensuring a comprehensive understanding of the legal and medical issues at hand.


Courtroom Representation:

  • Support senior attorneys in courtroom proceedings, including hearings, motions, and trials. Assist in presenting legal arguments, examining witnesses, and introducing evidence to build a compelling defense for clients.


Document Management:

  • Organize and manage voluminous case documents, medical records, and evidentiary materials. Implement efficient document review processes to streamline case preparation and enhance overall litigation strategy.


Collaboration with Experts:

  • Work closely with medical experts, consultants, and expert witnesses to strengthen the defense's medical and scientific aspects. Coordinate the integration of expert opinions into legal strategies to bolster the credibility of the defense.


Settlement Negotiations:

  • Engage in settlement negotiations under the guidance of senior attorneys, collaborating with opposing counsel to explore favorable resolutions when appropriate. Analyze the strengths and weaknesses of cases to provide informed recommendations on settlement options, always prioritizing the best interests of clients.



Requirements:

  • Juris Doctor (J.D.) degree from an accredited law school and admission to the CA state bar.
  • 2-5 years of experience with a background and experience in medical malpractice defense. A proven track record of handling cases related to healthcare litigation, with a deep understanding of medical terminology, procedures, and standards of care.
  • Exhibit strong legal research capabilities and excellent writing skills. The ability to craft clear, concise, and persuasive legal documents, including pleadings, motions, and briefs, is crucial for effective representation in medical malpractice cases.
  • Demonstrate experience in all phases of litigation, from case initiation through discovery, motion practice, and trial. Prior courtroom experience, including conducting depositions and arguing motions, is highly desirable.
  • Possess excellent communication skills, both written and verbal, to effectively interact with clients, expert witnesses, and colleagues. The ability to convey complex legal concepts in a comprehensible manner and maintain positive client relationships is essential.
